Gas Safety Certificate for Scotland Landlords

The annual gas safety check is one of the strictest landlord obligations in Scotland. It runs on a fixed 12-month cycle with no grace period and carries criminal penalties for non-compliance.

The Core Requirement

Under Regulation 36 of the Gas Safety (Installation and Use) Regulations 1998, you must have the gas appliances and flues covered by your duty checked within 12 months of installation and at intervals of no more than 12 months. You must also maintain relevant gas fittings and installation pipework in a safe condition. Gas safety is part of the repairing standard under Section 13(1)(c) of the Housing (Scotland) Act 2006.

The inspection covers the gas equipment for which you are responsible, including landlord-provided boilers, gas fires, hobs, ovens, pipework, and flues. You are not responsible for a tenant-owned appliance or a flue or chimney that serves only that appliance, but you remain responsible for the relevant associated installation pipework.

Who Can Do the Check

Only an engineer registered with the Gas Safe Register and holding active, category-specific qualifications for the appliances being inspected. Before any work begins, check the engineer's Gas Safe ID card to confirm their registration is current and their listed competence codes cover the specific appliances in your property (domestic boilers, gas fires, gas hobs, etc.).

The Gas Safe Register replaced CORGI in 2009. A CORGI registration hasn't been valid for over 15 years.

The 2-Month Early Renewal Window

Regulation 36A lets you schedule the annual check up to 2 calendar months before the current record's expiry date without shortening the renewal cycle. The new Landlord Gas Safety Record (LGSR) keeps the original anniversary date as the deadline for the following year.

If you schedule the check earlier than 2 months before expiry, the 12-month clock resets from the new inspection date — which means your anniversary shifts forward and you lose part of the cycle.

This window is designed to prevent the late-booking crunch that hits every December and January. Book your engineer 6–8 weeks before the current record expires.

Document Delivery and Retention

  • Existing tenants: a copy of the LGSR within 28 calendar days of the completed check
  • New tenants: a copy of the current valid LGSR before they move in
  • Retention: keep every LGSR for at least 2 years, or until two subsequent annual checks have been completed and documented

Track the dates you sent copies to tenants. If it ever comes to a tribunal dispute, you'll need to prove you met the 28-day delivery rule.

Unsafe Appliance Classifications

If the engineer finds a problem, it falls under the Gas Industry Unsafe Situations Procedure (GIUSP):

Immediately Dangerous (ID) — risk to life right now. The engineer disconnects the gas supply to the appliance and labels it. You cannot reconnect or allow the tenant to use it until a Gas Safe engineer has repaired or replaced it.

At Risk (AR) — faults that could endanger life or property. The engineer isolates the appliance. Repair or replacement by a Gas Safe engineer is required before it can be used again.

In both cases, get the remedial work done and documented before the appliance is used again. Never reconnect an isolated appliance yourself.

The Penalties

Failing to maintain a valid LGSR is a criminal offence enforced by the Health and Safety Executive:

  • Unlimited fines for breaches of Regulation 36
  • Up to 2 years' custody for severe or reckless non-compliance

Properties Without Gas

If your property has no gas supply and no gas appliances, you don't need a gas safety check. But document that fact — a signed statement confirming no gas supply, with the date and the property address. If a tenant later installs their own gas appliance with your permission, the tenant is responsible for its safety checks and any flue solely connected to it; you must still maintain relevant associated installation pipework safely.
