How to Become a Landlord in Sunderland: Licensing, Rules and Buy-to-Let Requirements

Sunderland's low entry prices — terraced houses regularly listed under £75,000 and flats from around £40,000 — and gross yields that often exceed 6% make it one of the North East's more accessible buy-to-let markets. But accessible doesn't mean unregulated. Before you let your first property, there's a specific set of legal obligations to get right.

Do You Need a Licence?

That depends on how many people will live in the property and how many separate households they form.

Sunderland City Council operates mandatory HMO licensing only. There is no selective licensing for standard single-household rentals, and no additional HMO licensing for smaller shared houses. This means:

  • Letting to a single household (a family, a couple, a sole occupant): no property licence required from the council.
  • Letting to 3–4 unrelated people who share or lack a basic amenity as their only or main residence: legally an HMO, but no licence needed in Sunderland. You must still comply with the HMO Management Regulations 2006.
  • Letting to 5+ people from 2+ households who share or lack a basic amenity and use the property as their only or main residence: mandatory HMO licence required. Application via the council's online portal, with a total cost of £1,037 for a standard 5-bed property in 2026/27.

Legal Requirements to Check Before Letting

Whether or not you need an HMO licence, landlords letting property in Sunderland still need to meet the applicable requirements, including:

  • Gas safety certificate — annual check of landlord-provided gas appliances and associated flues by a Gas Safe registered engineer
  • EICR — satisfactory Electrical Installation Condition Report, with inspections at least every 5 years or sooner if the report specifies
  • EPC — Energy Performance Certificate at minimum grade E for properties covered by the Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015, unless a valid exemption is registered
  • Deposit protection — if you take a tenancy deposit, protect it in a government-approved scheme and serve the prescribed information within 30 days
  • Smoke alarms on every storey with a room used as living accommodation; carbon monoxide alarms in rooms used as living accommodation with a fixed combustion appliance (excluding gas cookers)

From 2027, all private landlords in Sunderland must also register on the national PRS Database. Voluntary registration opens 15 December 2026; mandatory registration for the North East runs from 15 June 2027 to 14 September 2027.

Planning Permission for Shared Houses

If your investment strategy involves letting to multiple unrelated tenants, check the property's ward. In Barnes, Hendon, Millfield, St Michael's and St Peter's, Sunderland's Article 4 Direction removes permitted development rights for converting a family house (C3) to a small HMO (C4, 3–6 occupants). You'll need full planning permission before converting. Properties housing seven or more occupants require sui generis planning permission everywhere in the city.

The Cost of Getting It Wrong

A landlord operating an unlicensed HMO in Sunderland faces civil penalties of up to £40,000 per offence, or criminal prosecution with an unlimited fine. Tenants can also apply for rent repayment orders covering up to 24 months of rent. These aren't theoretical — the council's housing enforcement team actively investigates unlicensed properties, and the Renters' Rights Act 2025 has strengthened the penalties.

For a first-time landlord, getting the compliance framework right from the start is significantly cheaper than correcting it after an enforcement notice.

The Sunderland Landlord Licensing guide walks through the entire compliance sequence — from address verification and threshold assessment through to the licence application, document requirements and ongoing conditions — in one structured workflow.
