Sunderland University Area HMO Licensing: Student Houses and What Landlords Need
Student shared houses around the University of Sunderland's City Campus and Sir Tom Cowie Campus at St Peter's are a staple of the local rental market. But the licensing and planning rules for these properties trip up landlords who assume a four-student house is treated the same as a six-student house. It isn't.
When Does a Student House Need a Licence?
The threshold is the same as for any other shared house in Sunderland: five or more occupants from two or more separate households who share or lack a basic amenity and use the property as their only or main residence. Each unrelated student counts as a separate household, so a house with five unrelated students living there during term time automatically meets the mandatory HMO licensing threshold.
A four-student house with four unrelated tenants is legally an HMO — but it doesn't need a licence in Sunderland because the council runs no additional HMO licensing scheme for smaller shared houses. It still needs to comply with the HMO Management Regulations 2006, including fire safety, common area maintenance and display of the manager's contact details.
University-managed halls of residence are exempt from HMO licensing under Schedule 14 of the Housing Act 2004, provided they're managed by the educational establishment and subject to an approved code of practice. Private student houses are not covered by this exemption.
The Article 4 Planning Problem
Most of the popular student rental areas in Sunderland — St Peter's, Millfield, Hendon, Barnes and St Michael's — fall within the Article 4 Direction area. In these wards, converting a Class C3 dwelling to a Class C4 small HMO (3–6 occupants) requires full planning permission. Outside the Article 4 wards, this conversion benefits from permitted development rights.
This catches many student landlords unaware. You might have a perfectly valid HMO licence from the council's housing team, but if you haven't obtained C4 planning permission from the planning department, you're vulnerable to planning enforcement action. The council has historically issued shortened HMO licences — sometimes just 12 months — where planning permission is missing, giving the landlord time to regularise the position before the licence comes up for renewal.
For properties housing seven or more students, the use class is sui generis (large HMO), which requires full planning permission everywhere in Sunderland, regardless of ward.
The 10% Density Rule
Sunderland's Core Strategy Policy H6 restricts HMO density. Planning permission for a new HMO is routinely refused if HMO concentration would exceed 10% within a 100-metre radius of the property, or if the proposed HMO would leave a residential home sandwiched between two existing HMOs. In heavily converted streets near the university, this density cap means some properties effectively cannot obtain C4 planning permission even if the landlord wants to.

Practical Compliance Steps for Student Landlords
If you're renting to students in Sunderland:
- Count heads, not bedrooms — five or more unrelated students means a mandatory HMO licence
- Check the ward — St Peter's, Millfield, Hendon, Barnes and St Michael's require C4 planning permission
- Check density — the 10% rule may block planning permission regardless of your application
- Maintain certificates — gas safety, EICR, EPC (grade E minimum), fire alarm and emergency lighting tests
- Provide waste instructions — the licence conditions require written instructions to tenants on bin collection days and sorting rules, with a log proving you issued them
The Sunderland Landlord Licensing guide covers both the licensing application and the Article 4 planning requirements in detail, including a ward map and document checklist specific to the student rental corridor.
