Invalid Notice to Leave Scotland: Common Mistakes That Void Your Notice

A notice to leave must use the prescribed style. In McAnally v Boyle [2025] UT 53, the Upper Tribunal explained that an error in completing the prescribed form invalidates it only if the error materially affects the notice's effect under Section 73 of the 2016 Act. A notice that is not in the prescribed style cannot be relied on.

Here are the mistakes that actually cause notices to fail, drawn from what the Housing and Property Chamber sees in practice.

Using the Wrong Form or an Outdated Template

The notice to leave must use the exact prescribed form in force on the date you serve it. Until 31 March 2027, that form is set out in Schedule 5 of the Private Residential Tenancies (Prescribed Notices and Forms) (Scotland) Regulations 2017 (SSI 2017/297). From 1 April 2027, a new form under SSI 2026/279 takes over and the old one becomes invalid.

The safest route is the mygov.scot "Create a Notice to Leave" generator, which produces the current prescribed form. Third-party templates downloaded from legal stationery sites, landlord forums or older document packs routinely contain the pre-2017 Short Assured Tenancy notice or a layout that is not in the prescribed style. An error in completing the prescribed form is invalidating only if it materially affects the notice's effect; an incorrect ground or a shortened notice period can be material.

Miscalculating the Notice Period End Date

Day-counting errors can invalidate a notice. The rules are precise:

  • Day 0 is the day the notice is posted or emailed.
  • Days 1–2 are the 48-hour deemed-delivery allowance (mandatory for postal and email service).
  • Day 3 is the first clear day of the statutory notice period (28 or 84 clear days depending on the ground and tenancy length).
  • The expiry date in Part 4 must be Day 31 (for a 28-day notice) or Day 87 (for an 84-day notice) — the day after the last clear day.

Shortening the statutory notice period is fatal. A common error is forgetting the two-day postal allowance entirely, which makes the notice expire two days early. Another is setting the expiry date on the last clear day rather than the day after it. If you serve by hand, the delivery allowance does not apply — Day 1 is the first clear day — but landlords who switch service method mid-process sometimes add postal days that should not be there.

Selecting the Wrong Eviction Ground

All 18 grounds under Schedule 3 of the Private Housing (Tenancies) (Scotland) Act 2016 are now discretionary — the Coronavirus (Recovery and Reform) (Scotland) Act 2022 made that permanent. But each ground still has its own factual requirements, and citing the wrong one voids the notice.

The most frequent mismatch: a landlord who wants to sell cites Ground 4 (landlord intends to live in property) instead of Ground 1 (landlord intends to sell). Ground 1 requires proof of a genuine intention to sell at market value within three months. Ground 4 requires proof of an intention to occupy the property as the landlord's principal home for at least three months. The evidence package is entirely different, and a notice that cites one ground but describes facts matching the other will not survive scrutiny.

If you rely on more than one ground, state each ground and the facts supporting it. Whether an incomplete Part 3 invalidates the notice depends on whether the omission materially affects its effect; details such as the amount and period of rent arrears can be critical.

Serving by Email Without Contractual Consent

Email service is valid only if the Private Residential Tenancy agreement contains an express written clause authorising service by email. Ordinary email without that clause is not valid service under Scottish law, regardless of whether the tenant actually opens and reads the notice. If the PRT was signed on a standard template that does not mention electronic service, you must use recorded delivery post or personal hand delivery.

Failing to Include Mandatory Statutory Notes

The prescribed form includes statutory notes for the tenant explaining their rights, the advice services available, and the local authority homelessness duty. These notes are part of the prescribed form. Removing them, editing them, or attaching the notice without the notes page turns the document into something other than the prescribed form, and McAnally v Boyle is clear about the consequence.

What Happens When a Notice Is Invalid

The Tribunal cannot grant an eviction order on the back of an invalid notice, and it cannot fix the defect for you. The only remedy is to serve a fresh, correctly prepared notice and wait out the full notice period again. For an 84-day ground with the postal allowance, that is nearly three months lost.

Before serving, run through every element: the form version matches the date of service, the ground matches your actual circumstances, the facts are set out in detail, the day count includes the correct delivery allowance, and the statutory tenant notes are present and unaltered. Our Notice to Leave in Scotland guide includes a pre-service verification checklist and a day-counting worksheet that walks through each calculation step by step.
