Serving a Notice to Leave Scotland: Methods, Proof, and Pitfalls

A perfectly drafted notice to leave served the wrong way is as good as no notice at all. Scottish law prescribes both the form and the manner of service, and the First-tier Tribunal will ask for proof that you served correctly before it even considers your eviction application.

Three Lawful Service Methods

Recorded Delivery Post

This is the default and the safest option. Send the notice by Royal Mail Signed For or Special Delivery to the tenant's address at the let property.

When you post by recorded delivery, a 48-hour deemed delivery allowance applies under Scottish law. The notice is treated as received two calendar days after posting, regardless of when the tenant actually opens it or whether they sign for it. This means your notice period starts running from Day 2 after the posting date.

Keep:

  • The Royal Mail tracking receipt
  • The proof of posting slip
  • A screenshot or print of the online tracking confirmation showing delivery status

Personal Hand Delivery

Deliver the notice directly into the hands of the adult tenant. There's no deemed delivery period — the notice takes effect immediately.

You need evidence that delivery happened:

  • A signed receipt from the tenant acknowledging they received the notice, with the date
  • A witness who was present and can provide a written statement

Personal delivery gives you the tightest timeline (no 48-hour addition), but the proof requirement is harder. If the tenant refuses to sign and you don't have a witness, you have no evidence of service.

Email

Email is only valid if the PRT agreement contains express written consent to electronic service. This must be a specific clause — not a general "communications may be sent by email" provision, but explicit agreement that statutory notices can be served electronically.

If the PRT doesn't include this clause, email service is invalid, full stop. Ordinary email without contractual authorisation does not constitute valid service under Scottish law.

When email service is permitted, the same 48-hour deemed delivery allowance applies. Retain:

  • The sent email with full headers
  • The PDF attachment of the notice
  • Any delivery or read receipt

The 48-Hour Rule in Practice

The delivery allowance applies to post and email, not hand delivery. Here's how it changes the maths:

28-day notice by post: Day 0 (posting) → Day 2 (deemed receipt) → Day 30 (last clear day) → Day 31 (earliest valid expiry date in Part 4).

84-day notice by post: Day 0 (posting) → Day 2 (deemed receipt) → Day 86 (last clear day) → Day 87 (earliest valid expiry date).

28-day notice by hand delivery: Day 0 (delivery) → Day 28 (last clear day) → Day 29 (earliest valid expiry date).

Missing the 48-hour allowance on a posted notice shortens your period by two days. The notice is invalid.

Serving on Joint Tenants

If the PRT names two or more tenants, serve the notice on all of them. The safest approach is to send a separate copy to each tenant by recorded delivery, even if they live at the same address. This gives you an individual tracking receipt for each.

From 1 April 2027, under SSI 2026/279, the rules for joint tenancies are updated — including provisions about one joint tenant serving notice for all. But for landlord notices to leave, the principle remains: every tenant named on the PRT should receive the notice.

What Counts as Proof at the Tribunal

When you lodge Form E with the Housing and Property Chamber, you attach your proof of service. The tribunal expects:

  • Post: Royal Mail tracking log showing the item was posted and delivered (or attempted)
  • Hand delivery: A signed and dated receipt, or a witness statement with the witness's contact details
  • Email: The sent email with visible headers, the attached PDF, and any delivery confirmation

If you can't demonstrate that the notice reached the tenant by a lawful method, the tribunal can dismiss your application before it reaches the merits.

The Notice to Leave in Scotland guide includes service audit templates for each delivery method, so you can build your proof file as you go.
