Joint Contract-Holder Deposit Rules in Wales: Changes, Transfers, and Re-Service
Deposit Duties Do Not End at Day 30
Protecting the deposit and serving the required information within 30 days satisfies the initial compliance obligation. But the Renting Homes (Wales) Act 2016 imposes ongoing administrative duties whenever the occupation contract changes — and joint contract-holder variations are the most common trigger.
When a Joint Contract-Holder Leaves
The 2016 Act introduced formal procedures for adding or removing joint contract-holders without terminating the entire contract. When an outgoing joint contract-holder transfers their interest, the landlord must:
- Serve the correct prescribed form — Form RHW11 (for a transfer under Section 69(1)(b)) handles most departures
- Update the scheme registration — the deposit record must reflect only the current contract-holders
- Re-serve required information — the fresh pack must include the details of the remaining and incoming contract-holders
The deposit itself does not need to be deprotected and reprotected. The scheme account stays active; it is the registration details and the required information that must be updated.
When a Joint Contract-Holder Joins
If a new contract-holder joins the occupation contract — for example, a partner moving in — the same three steps apply. The prescribed form will depend on the type of transfer (Form RHW11 for a standard variation, Form RHW13 for a fixed-term rights transfer). The landlord must update the scheme registration to include the new party and serve updated required information on all current contract-holders.

Death of a Joint Contract-Holder
Under Section 142, when a joint contract-holder dies, the remaining contract-holders continue under the existing contract. The landlord serves Form RHW14 to acknowledge the change and updates the scheme records to remove the deceased party. Required information should be re-served to reflect the current position.
Financial Arrangements Between Contract-Holders
It is common for an outgoing contract-holder to ask the incoming contract-holder to reimburse their share of the deposit directly. This is a private financial arrangement between the contract-holders. It does not change the landlord's statutory obligations.
The deposit held by the scheme or by the landlord (under insured protection) remains the same sum. The landlord does not need to collect a fresh deposit from the incoming contract-holder unless the parties agree to a deposit top-up — in which case the additional sum triggers its own 30-day protection deadline.
Fixed-Term to Periodic Conversion
When a fixed-term standard occupation contract expires without a new fixed-term being agreed, it converts to a periodic standard occupation contract by operation of law. The deposit protection carries over — there is no need to deprotect and reprotect.
However, if the terms of the periodic contract differ materially from the fixed-term contract (for example, a different rent amount triggering a deposit top-up), the landlord should update the scheme registration and re-serve required information reflecting the current contract terms.
Property Sales and Agent Transfers
When a property is sold to a new landlord, Form RHW3 must be served within 14 days to notify the contract-holder of the change in landlord identity. The deposit must transfer to the new landlord's scheme account (for custodial protection) or the new landlord must establish fresh insured protection. Updated required information naming the new landlord must be served within 30 days of the legal assignment.
The Wales deposit protection guide covers each mid-tenancy variation with the correct prescribed form references and a re-service checklist.
