Wales Occupation Contract Deposit Protection and Mandatory Enclosures
Deposit Protection Under the 2016 Act
Under Section 45 and Schedule 5 of the Renting Homes (Wales) Act 2016, any security deposit taken from a contract-holder must be protected in a government-authorised tenancy deposit scheme within 30 days of receipt. The three authorised schemes operating in Wales are the same ones available in England: the Deposit Protection Service (DPS), MyDeposits, and the Tenancy Deposit Scheme (TDS).
Within the same 30-day window, the landlord must issue the statutory Prescribed Information to the contract-holder — a document confirming the amount deposited, the scheme it is held with, and the circumstances under which deductions can be made at the end of the contract.
Failure to protect the deposit or serve the Prescribed Information on time gives the contract-holder grounds to apply to the county court for a penalty of between one and three times the deposit amount. The landlord also cannot serve a valid Section 173 no-fault notice until the deposit is properly protected.
The Mandatory Enclosures
The written statement is the core document, but it does not stand alone. Safety and compliance certificates have their own delivery deadlines and should be retained with the written statement. Missing any of these can affect the landlord's fitness-for-human-habitation obligations under Sections 91 and 92 of the Act.
Energy Performance Certificate (EPC). A valid EPC demonstrating a minimum rating of E must be provided before the contract-holder occupies the dwelling. A valid EPC must also be available when marketing the dwelling under the Energy Performance of Buildings (England and Wales) Regulations 2012. A property rated F or G may be let only where a valid exemption is registered on the PRS Exemptions Register.
Gas Safety Certificate. A current Gas Safety Certificate must be delivered before the occupation date and renewed annually thereafter. The certificate must cover every gas appliance, flue and fitting in the dwelling.
Electrical Installation Condition Report (EICR). A valid EICR must be provided within 14 days of the occupation date, with inspections at intervals of no more than 5 years or sooner if the previous report specifies a shorter interval. The Renting Homes (Fitness for Human Habitation) (Wales) Regulations 2022 made this a mandatory fitness requirement.
Interlinked smoke alarms and carbon monoxide alarms. Mains-powered interlinked smoke alarms must be installed on every storey of the dwelling. Carbon monoxide alarms must be present in every room containing a gas, oil or solid-fuel burning appliance. These are fitness-for-human-habitation requirements — a dwelling without them is statutorily deemed unfit.
The Fitness Consequences
Under the 2016 Act, a dwelling that lacks an EICR, a current gas safety certificate, or compliant interlinked smoke alarms is deemed unfit for human habitation. The consequences are immediate:
- Rent does not accrue for any day or part-day during which the dwelling remains unfit.
- The contract-holder is entitled to a statutory set-off against rent claims.
- The landlord's ability to serve possession notices is restricted until the fitness defects are remedied.
This is a stronger regime than the English equivalent. In Wales, the statutory fitness standard is not just a repairing obligation — it is a precondition for collecting rent.

Form RHW2: The Landlord's Address Notice
Alongside the written statement, the landlord must serve Form RHW2 (Notice of Landlord's Address) within 14 days of the occupation date. This provides the contract-holder with an address in England or Wales to which they can send formal notices and documents.
If the landlord's address changes, Form RHW4 must be served within 14 days of the change. If the property is sold, the new owner must serve Form RHW3 within 14 days of legal completion.
Putting It All Together
The compliance sequence for a new letting in Wales runs:
- Rent Smart Wales registration and licensing confirmed.
- All safety certificates obtained and fitness standards met before the occupation date.
- Written statement completed using the current model.
- Written statement and Form RHW2 delivered within 14 days; Gas Safety Certificate and EPC provided before occupation; EICR copy provided within 14 days.
- Security deposit protected and Prescribed Information issued within 30 days.
Each deadline is independent — meeting the 14-day written statement deadline does not extend the 30-day deposit deadline, and vice versa.
