Lambeth Licence Appeal: How to Challenge a Penalty or Refusal at the Tribunal

A civil penalty notice from Lambeth Council is not the final word. Landlords who receive a financial penalty for operating an unlicensed property, breaching licence conditions, or failing HMO management regulations have a statutory right to appeal to the First-tier Tribunal (Property Chamber). A licence refusal can also be challenged. But the deadlines are strict and the process has steps that are easy to miss.

Two Types of Appeal

Civil penalty appeals arise when Lambeth issues a financial penalty under Section 249A of the Housing Act 2004. Since 1 May 2026, that penalty can be up to £40,000 per offence. Lambeth has been active on enforcement — the council issued over £1.1 million in civil penalties across 450 enforcement actions within a single 12-month period.

Licence refusal or conditions appeals arise when the council refuses to grant a licence, or grants one with conditions the landlord considers unreasonable (such as an occupancy limit that does not reflect the property's layout).

The routes are different:

Appeal Type Form Fee Deadline
Civil penalty (Section 249A) Form HO4 £200 28 calendar days from the Final Penalty Notice
Licence refusal or conditions Form HMO Check GOV.UK tariff 21 calendar days from the Decision Notice

The Civil Penalty Process Step by Step

Lambeth's enforcement follows a fixed sequence:

  1. Notice of Intent. The council sends a formal notice proposing a specific penalty amount and setting out the alleged offence.
  2. 28-day representation window. You have 28 days to submit written representations — explaining why the penalty is wrong, why the amount is disproportionate, or providing evidence the council did not have.
  3. Final Penalty Notice. The council reviews representations and issues a final notice with the determined penalty.
  4. Appeal window. You have 28 calendar days from the Final Notice to lodge Form HO4 with the regional tribunal office, attaching the Final Notice, your grounds of appeal, and the £200 fee.

Missing the 28-day deadline puts the appeal out of time; seek advice immediately about whether an extension can be requested.

What Happens at the Tribunal

A civil penalty appeal is heard as a complete re-hearing. The tribunal does not merely check whether Lambeth acted reasonably — it evaluates the case from scratch. You can submit new evidence that was not available to the council. The tribunal can confirm the penalty, quash it entirely, or vary the amount (including increasing it, though that is rare).

For licence refusal appeals, the tribunal can confirm the refusal, overturn it and direct the council to grant the licence, or vary the conditions attached to the licence.

Hearings are usually held at the tribunal's London offices. Many cases are decided on paper without an oral hearing, particularly where the facts are not in dispute and the argument centres on the penalty amount.

Practical Considerations

Written representations at the Notice of Intent stage are your most cost-effective chance to reduce or cancel a penalty. Many landlords skip this step or send a brief email — a structured, evidenced response addressing each element of the council's case carries considerably more weight.

If you do appeal, the penalty is suspended until the tribunal decides. You do not need to pay while the appeal is pending.

Legal representation is not required at the tribunal, but for penalties approaching £40,000 a solicitor's involvement often pays for itself. For lower penalties, a well-prepared written submission can achieve the same result.

The Lambeth Landlord Licensing Guide covers the enforcement sequence from initial notice through tribunal appeal, including the representation deadlines and what to include at each stage.
