Liverpool HMO Room Sizes: Minimum Standards for Landlords

The National Minimum Room Sizes

Mandatory HMO licensing in Liverpool follows the national standards set by the Licensing and Management of Houses in Multiple Occupation (Mandatory Conditions of Licences) (England) Regulations 2018. The minimum sleeping room floor areas are:

Room use Minimum net floor area
Single occupant aged 10 or older 6.51 m²
Two occupants (couple) aged 10 or older 10.22 m²
Single occupant aged under 10 4.64 m²
Any room below 4.64 m² Cannot be used as sleeping accommodation

These are absolute statutory minimums. A room that falls even fractionally short cannot be used for that purpose, and the licence holder must not allow it.

How Floor Area Is Measured

The net floor area calculation excludes any part of the room where the ceiling height is below 1.5 metres. This matters for attic conversions, rooms under sloping roofs, and dormer bedrooms — common in Liverpool's Victorian terraces and converted houses.

If your attic bedroom measures 12 m² wall to wall but 3 m² of that area has a ceiling below 1.5 m, the room's usable floor area is 9 m². That clears the threshold for a couple (10.22 m²? No — in this example it does not). Measure carefully and measure honestly, because Liverpool's housing enforcement officers will verify during inspection.

Floor area is measured to the internal face of the walls. Built-in wardrobes and cupboards that a tenant could theoretically remove do count toward the total. En-suite bathrooms separated by a permanent wall do not.

When the 5-Person Threshold Triggers

A property needs a mandatory HMO licence when it is occupied by five or more people from two or more separate households who share one or more basic amenities (toilet, washing or cooking facilities). This applies across the entire city — every one of Liverpool's 64 wards, not just the 39 selective licensing wards.

A "household" under the Housing Act 2004 means members of the same family: married or cohabiting couples, parents and children, siblings, and relatives by blood, marriage, adoption or step-relationship. Five friends sharing a house are five separate households. A couple and three individual tenants are four households. Count the people and count the households — both thresholds must be met.

Properties below the five-person threshold are not caught by mandatory HMO licensing. But if the property sits in one of Liverpool's 39 selective licensing wards, a selective licence is still needed for any privately rented home unless a statutory exemption applies — whether it is a single-family let or a small HMO with three or four sharers.

Room Size Enforcement in Liverpool

Liverpool City Council's housing enforcement officers inspect HMO properties against the Housing Health and Safety Rating System (HHSRS) and the mandatory licence conditions. If a sleeping room is found to be below the minimum floor area, the council can:

  • Issue a condition on the licence capping the room's occupancy to zero
  • Require the licence holder to stop using the room for sleeping
  • Reduce the maximum permitted number of occupants on the licence

Letting a room that does not meet the minimum size standard is a breach of licence conditions. Each breach can attract a civil penalty of up to £40,000. If the council determines that overcrowding is persistent, it may refuse to renew the licence or revoke it mid-term.

Practical Advice for Liverpool HMO Landlords

Measure every bedroom before you apply for the licence, not after. The LAR portal application asks for the number of habitable rooms and the occupancy profile. If you declare five bedrooms but one turns out to be 5.8 m², you have a room that cannot house anyone aged 10 or over — and your licence may be issued with a lower occupancy cap than expected.

Commission scaled floor plans. Mandatory HMO applications require detailed floor plans showing room dimensions, uses and fire escape routes. Having these drawn by a professional avoids disputes over measurements during the council's inspection.

Account for sloping ceilings. In terraced loft conversions — common across L7, L8 and L15 — the usable area can be significantly smaller than the room feels. Mark the 1.5 m ceiling line on your plans.

Check shared facilities. Beyond room sizes, mandatory HMOs must provide adequate shared amenities. Check Liverpool's current licence conditions for the required bathroom and kitchen provision before letting.

Our Liverpool landlord licensing guide covers the full mandatory HMO application process — room standards, the documents you need, the LAR portal steps and the fee tiers — alongside the selective licensing requirements for properties below the five-person threshold.
