Newham Gas Safety and EICR Renewal for Licensed Properties

Getting your Gas Safety Certificate and EICR right for the initial licence application is one thing. Keeping them current throughout a five-year licence term is another — and a lapse can put you in breach of licence conditions even if the licence itself is still technically valid.

Gas Safety: Every 12 Months, No Exceptions

The Gas Safety (Installation and Use) Regulations 1998 require landlords to have all gas appliances, flues, and pipework inspected by a Gas Safe registered engineer every 12 months. The engineer produces a Gas Safety Record (CP12) after each inspection.

This is not a one-time obligation at the licence application stage. Newham's licence conditions require landlords to maintain a valid CP12 throughout the licence term. A certificate that expires mid-licence puts you in breach of both the national gas safety regulations and your Newham licence conditions.

Practical tip: Book your annual gas safety check at least two weeks before the previous certificate expires. Engineers get busy, and a gap — even a short one — is technically a breach. You can have the check done up to two months early without losing time: if the current certificate still has up to two months left, the new certificate's 12-month validity runs from the expiry date of the old one, not the inspection date.

EICR: Every 5 Years

The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 require an Electrical Installation Condition Report at intervals of no more than five years. The report must be carried out by a qualified and competent person (typically registered with NICEIC, NAPIT, or ELECSA).

The EICR must show an overall "Satisfactory" result. If the report identifies C1 (danger present) or C2 (potentially dangerous) defects, those must be resolved and the installation retested before the report is valid for licensing purposes. FI (further investigation) recommendations should also be addressed.

For a five-year Newham licence, the EICR you submitted with your application will likely expire before your licence does. If you were granted a licence in 2024 with an EICR from that year, the report will be due again by 2029 — but if the EICR was already a year or two old at application, you may need a new one before the licence term ends.

What Happens If a Certificate Lapses

Breach of licence conditions. Newham licence conditions require ongoing compliance with safety standards. A lapsed gas certificate or expired EICR is a breach even if no hazard is actually present.

Enforcement powers. The council can serve an improvement notice, vary licence conditions, or — in serious cases — take enforcement action including civil penalties of up to £40,000 for a licence condition breach.

Inspection risk. Newham requires licence holders to carry out quarterly property inspections and maintain written logs. If a council compliance officer requests documentation and finds expired safety certificates, the consequences escalate quickly.

EPC: A Longer Cycle

Energy Performance Certificates are valid for 10 years and don't need annual renewal. But verify the expiry date — if the EPC was issued early in the property's letting history, it may expire during your current licence term. Properties must meet Minimum Energy Efficiency Standards (MEES), currently a minimum rating of E.

The EPC also affects your fees. An EPC rated A+, A, B, or C qualifies for the £50 Warmer Homes discount on Newham licensing fees. If your EPC expires and you need a new one for a renewal application, aim to improve the rating to C or above before the assessment.

Building a Renewal Calendar

The simplest way to stay compliant is to track three dates per property:

  1. Gas Safety Certificate expiry: 12 months from the last CP12
  2. EICR expiry: 5 years from the report date
  3. Licence expiry: Up to 5 years from issue

Set reminders at least one month before each date. For multi-property portfolios, stagger inspections so they don't all fall in the same month.

Our Newham landlord licensing guide includes a renewal tracker worksheet for scheduling gas, electrical, and licence renewal dates across the full five-year term.
