Notice of Variation Northern Ireland: Deposit Rules When a Tenancy Changes
When a Tenancy Changes Mid-Stream
A tenancy rarely stays frozen in its original terms. Rent increases, joint tenants leaving or arriving, a fixed term rolling into a periodic tenancy — each variation creates compliance obligations that landlords in Northern Ireland need to handle correctly, particularly around deposit protection.
Record a change to the tenancy in writing and update the deposit scheme details when the parties or other relevant information change. For deposit compliance, the statutory clocks are 28 days to protect new deposit money and 35 days to serve prescribed information, both measured from receipt of that money; the deposit rules described here do not establish a separate 28-day Notice of Variation deadline.
What to Record When a Tenancy Changes
The most common changes affecting deposit records are:
A joint tenant leaving or a new joint tenant joining. When the composition of tenants changes, the prescribed information originally served at the start of the tenancy no longer reflects the parties to the agreement. The deposit scheme record needs updating, and fresh prescribed information must be served on the new tenant(s) naming all current parties and any relevant third-party deposit payers.
A rent change. If the rent changes, the one-month deposit cap recalculates against the new rent figure. A deposit that was compliant at £700/month rent might exceed the statutory cap once rent falls to £650/month (if the deposit was set at the old higher rent level). Landlords must check whether the existing deposit still falls within the new one-month-rent ceiling.
A fixed term ending and the tenancy continuing as periodic. While the deposit protection itself carries over automatically into a periodic tenancy (no need to re-protect), the landlord should verify that all scheme records and prescribed information remain accurate.
The Deposit Protection Angle
When a joint tenant changes, the deposit scheme record must reflect the new tenant lineup. Both TDS Northern Ireland and mydeposits Northern Ireland require landlords to update the tenancy details in their portal — adding or removing tenant names and contact information.
If a departing tenant's share of the deposit is returned and a new tenant contributes a replacement amount, that new money is a fresh deposit. It triggers a new 28-day protection clock and a new 35-day prescribed information window, running from the date the new funds are received. The existing protected deposit and the new contribution may need to be managed as separate scheme entries depending on the operator's process.
For tenancies where the deposit transfers in full (no money changes hands, just the tenant names change), update the scheme record and serve updated prescribed information on the incoming tenant. The original protection date remains valid if the deposit stays protected; a new 35-day period does not start just because tenant names changed.

How Deposit Deadlines Apply After a Change
If new deposit money is received, protect it within 28 days and serve prescribed information within 35 days of receipt. Failure to meet either deposit deadline is a continuing offence until the relevant duty is met.
Local councils can issue fixed penalty notices for deposit non-compliance. If a tenancy change also involves new deposit money, make sure the new amount is protected and the required prescribed information is served.
Practical Steps for Mid-Tenancy Changes
- Record the variation in writing and give the parties a copy
- Update the deposit scheme record with the new tenant details (log into TDS NI or mydeposits NI and amend the tenancy)
- Serve updated prescribed information for changed parties; if new deposit money was received, meet the 35-day deadline measured from receipt
- Check the deposit cap — if rent changed, verify the existing deposit does not exceed the new one-month ceiling
- File proof of service — get the tenant's signed acknowledgement of the written variation and updated prescribed information
