Northern Ireland Deposit Protection Rules 2026: What's Changed and What Hasn't

The Current State of Deposit Law in Northern Ireland

The deposit protection framework in Northern Ireland has been through its most significant reform period. The Private Tenancies Act (NI) 2022, which received Royal Assent on 28 April 2022, introduced changes that rolled out in phases — most deposit-related provisions came into force on 1 April 2023, with further PTA 2022 obligations phasing in through December 2025.

Here is where things stand as of 2026.

What Changed Under the PTA 2022 (Already in Force)

Deposit cap: one month's rent. Since 1 April 2023, a landlord cannot require or hold a deposit exceeding one calendar month's rent. For non-monthly rent cycles, the monthly equivalent must be calculated using the statutory formula (weekly rent × 52 ÷ 12, fortnightly × 26 ÷ 12, four-weekly × 13 ÷ 12). Exceeding the cap is a criminal offence carrying a council fixed penalty notice.

28-day protection deadline. The previous 14-day window for protecting a deposit in an approved scheme was extended to 28 calendar days from the date of receipt. This applies to all deposits received on or after 1 April 2023.

35-day prescribed information deadline. The window for serving prescribed information on the tenant and any relevant third-party payer was extended from 28 to 35 calendar days from receipt.

Continuing offence status. This is the most consequential change. Under previous law, failing to protect a deposit was a one-time offence subject to a six-month prosecution time limit. Under PTA 2022, failure to protect a deposit and failure to serve prescribed information are continuing offences; each breach accrues daily until that particular duty is met. A council can prosecute for a deposit that has been unprotected for years, with the offence continuing while it remains unprotected.

Legacy deposit transition rules. Deposits lawfully taken before 1 April 2023 at amounts exceeding one month's rent were not retroactively illegal — provided the tenancy continued uninterrupted. However, any renewal, variation, or new tenancy granted on or after 1 April 2023 subjects the retained deposit to the one-month cap. The excess must be returned.

What Has Not Changed

Two approved schemes only. TDS Northern Ireland and mydeposits Northern Ireland remain the only government-approved deposit scheme operators. No new scheme has been approved. The historical Letting Protection Service NI (LPSNI) is no longer operational.

Custodial and insured options. Both schemes still offer free custodial (scheme holds the money) and paid insured (landlord holds the money, pays a protection fee) models.

Prescribed information content. The Schedule 1 requirements under the 2012 Regulations remain substantively the same — property details, deposit amount, scheme information, landlord contact, deduction terms, dispute procedures, and the scheme's official leaflet.

ADR process. Alternative Dispute Resolution through the approved schemes operates on the same basis — the landlord bears the burden of proof for any deductions claimed.

Related Obligations That Now Apply

EICR requirement (1 December 2025). All private tenancies in Northern Ireland must now have a valid Electrical Installation Condition Report. This is not a deposit rule, but it is part of the broader PTA 2022 compliance package that landlords must meet. An EICR does not affect deposit protection directly, but councils enforcing one obligation often check others at the same time.

Tenancy Information Notice (TIN). Landlords must serve a TIN on tenants within 28 days of the tenancy start, covering the tenant's rights, the landlord's registration number, and key tenancy terms. Again, not a deposit rule per se, but a parallel duty under PTA 2022 that shares the same enforcement machinery.

What to Expect Going Forward

The Department for Communities has signalled further phases of PTA 2022 implementation, including provisions around fitness standards and notice periods. For deposit protection specifically, the current framework — 28-day protection, 35-day prescribed information, one-month cap, continuing offence — is the settled regime.

Landlords should review their compliance annually: confirm every active deposit is protected, prescribed information has been served, and the scheme record matches the current tenancy terms. When tenants or rent change, review the scheme record and the deposit cap; if new deposit money is received, the 28-day protection and 35-day prescribed information periods run from its receipt.

The Tenancy Deposits in Northern Ireland guide consolidates every current obligation into one compliance timeline, dated to the rules as of 2026, with worksheets for tracking deadlines across multiple properties.
