Oxford HMO Room Size Requirements: Minimum Sleeping Room Standards
The Minimum Floor Areas
Oxford City Council enforces the national mandatory room size standards set by the Licensing and Management of Houses in Multiple Occupation (Mandatory Conditions of Licences) (England) Regulations 2018. These aren't guidelines — they're licence conditions, and undersized rooms are a breach.
The thresholds for sleeping rooms:
- Single occupant aged 10 or over: minimum 6.51 m²
- Two occupants aged 10 or over: minimum 10.22 m²
- Child under 10: minimum 4.64 m²
- Any room under 4.64 m²: cannot be used as a sleeping room at all
These measurements refer to usable floor area, not total room dimensions. The distinction matters.
These thresholds assume the HMO has sufficient communal living space under the council's amenity guide. If it does not, the licence conditions set larger minimums: 8.5 m² for one person or 14 m² for two people. Where a sleeping room contains kitchen facilities for its occupants' exclusive use, the minimum is 14 m² for one person or 18 m² for two.
How Ceiling Height Changes the Calculation
Any floor space where the ceiling height is below 1.5 metres must be excluded from the usable floor area calculation. This catches rooms with sloped ceilings — attic conversions, rooms under eaves, and top-floor bedrooms in older Oxford terraces.
A room that measures 8 m² wall to wall might have only 5.5 m² of usable space once you exclude the area under a sloping roof. That puts it below the single-occupant threshold, and the council will not permit it as a bedroom on the licence.
When you submit dimensioned floor plans with your HMO application, the council expects you to show these measurements accurately. Officers verify them during pre-grant inspections, and discrepancies between your plans and the measured room trigger further scrutiny.
Maximum Occupancy on Your Licence
Every HMO licence specifies a maximum number of occupants and households permitted in the property. The council sets this based on room sizes, kitchen and bathroom facilities, and the property's physical layout.
For kitchen facilities, Oxford's Amenity and Facility Guide requires a minimum 7 m² shared kitchen for up to five occupants, with at least a four-ring hob, oven, grill, sink with drainer, adequate hot and cold water, work surfaces, and food storage. Larger HMOs need doubled kitchen amenities or expanded communal areas.
Sanitary facilities follow a ratio of one bathroom and one separate WC with wash hand basin per five occupants.
Exceeding the maximum occupancy stated on your licence is a breach of conditions — punishable by an unlimited court fine or a civil penalty up to £30,000. And if the council discovers you've been letting undersized rooms, that's evidence of operating in breach from the start.

What to Do If Rooms Are Borderline
Measure carefully before you apply. Use a laser measure for accuracy and note ceiling heights throughout the room, especially in converted properties. Draw your floor plans showing the 1.5-metre ceiling line where it applies.
If a room falls below the threshold, you have two realistic options: designate it as a common room or study (not a sleeping room) and reduce your maximum occupancy, or carry out structural work to increase usable floor area (removing built-in furniture sometimes helps, but you can't change ceiling height without major building work).
The council offers pre-application HMO advice visits at £280 per visit. An officer inspects the property and advises on whether your room layouts and occupancy numbers will satisfy the licence criteria before you commit to the full application fee.
Our Oxford Landlord Licensing Guide includes the complete amenity standards and room measurement methodology, so you can audit your property's capacity before the council does.
