PEI Illegal Rent Increase: Penalties, Void Notices, and Refund Orders

What Makes a Rent Increase Illegal in PEI

A rent increase is unlawful under the Residential Tenancy Act if any of the following apply:

  • Wrong form: The landlord used a custom letter, text message, invoice adjustment, or an old form from the repealed Rental of Residential Property Act instead of the prescribed Form 8
  • Short notice: Less than three weeks for a week-to-week tenancy, or less than three months for a month-to-month or fixed-term tenancy, between service and the effective date
  • Exceeded the guideline: The percentage applied was higher than the annual allowable guideline (2.0% for 2026, 2.1% for 2027) without a Director's order
  • Breached the 12-month rule: The increase was imposed before at least 12 months had passed after the last lawful increase or, if there had been no previous increase, after the date rent was first payable
  • Vacancy reset: The landlord charged a new tenant more than the lawful base rent established by the previous tenancy
  • Rounding error: The calculated amount was rounded above the exact cent-level result
  • Missing fields: Form 8 was incomplete — missing signatures, addresses, or dates

Any one of these is enough to invalidate the entire increase. They do not partially reduce it — the increase is void.

The Financial Consequences

When the Director finds a rent increase unlawful, the order typically requires the landlord to reimburse all excess rent collected — not just the increment above the guideline, but the entire increase amount for every month it was charged. The tenant may be authorized to deduct the overpayment from future rent payments, or the landlord may be given a deadline to pay the sum directly.

The Act also makes a contravention an offence. On summary conviction, the fine may be up to $25,000.

For a unit where the landlord charged an extra $50/month above the lawful amount for two years, that is $1,200 in refunds, plus the administrative disruption of a tribunal hearing.

If the landlord does not comply with the refund order and no appeal is filed within 20 days after a copy of the order is provided, the order may be filed with the Supreme Court of Prince Edward Island for enforcement.

No Consent Defence

A common misconception: if the tenant agreed to pay the higher amount, the increase is valid. It is not. Section 5 of the Act makes a tenant's waiver of rights or protections void unless the Act specifically allows it; Sections 47(1) and 49(1) require rent increases to comply with the Act and the guideline. Informal consent — written or verbal — does not authorize an increase above the guideline without an order. The landlord remains liable for the full overpayment even if the tenant signed a letter agreeing to it.

Defective Notices Cannot Be Fixed After the Fact

A Form 8 that specifies an effective date with insufficient notice cannot be adjusted by the Residential Tenancy Office to take effect a month later. The notice is void, and the landlord must issue a brand-new Form 8 with a fresh applicable notice period.

The same applies to mathematical errors. A notice stating a 2.5% increase when the guideline is 2.0% is not reduced to 2.0% — it is invalid. Start over.

How to Avoid Problems

The compliance sequence is mechanical: verify the base rent, confirm the 12-month rule is satisfied, apply the correct percentage to the exact cent, complete every field on Form 8, serve it using a permitted method with the mailing deeming buffer if applicable, and keep proof of service.

Errors happen when landlords skip a step or rely on memory instead of documentation. The cost of a voided notice is not just the refund — it is the delay. Restarting the required notice period can push your increase back.
