Proof of Service for a Rent Increase in Yukon
A tenant who challenges a rent increase at the Residential Tenancies Office will almost always argue that they were never properly served. Without documented proof of service, a landlord's word alone rarely settles the matter.
The Declaration of Service Form
The RTO provides an official form: Declaration of service — landlord serving tenant. It is the RTO's form for documenting that a landlord served documents on a tenant.
The declaration records:
- The name of the person served
- The date and time of service
- The complete address or email address where the tenant was served or documents were sent
- The method of service (personal delivery, registered mail, door or conspicuous-place posting plus mail, or consented email)
- The name and signature of the person making the declaration
Complete the declaration immediately after delivery — not days later from memory.
What Else to Keep
Beyond the declaration, a complete audit file for each rent increase should include:
- A copy of the served Notice of rent increase (Form YG(6942CS)), signed and dated.
- The rent calculation worksheet showing how you arrived at the exact new rent figure.
- Postal registration receipt if served by registered mail — this proves the mailing date and is essential for the five-day deemed-receipt calculation.
- Email delivery confirmation if served by consented email — the delivery header showing date, time, and recipient address.
- A copy of the written email consent from the tenant, if applicable.
- The current tenancy agreement showing the parties, commencement date, and current rent.
How Long to Keep Records
The Residential Tenancies Act does not specify a mandatory retention period for these documents. As a practical matter, keep them for at least the duration of the tenancy and a reasonable period afterwards. A dispute can be filed while the tenancy is still active, so disposing of records prematurely leaves you without evidence at exactly the moment you need it.

Why It Matters
If a rent-increase notice is served by an unauthorized method and no substituted-service order applies, serve a new notice by an authorized method and allow the full notice period from valid service.
An organised compliance file takes ten minutes to assemble on the day of service. Recreating one months later, under the pressure of a dispute hearing, is both harder and less convincing.
The Yukon Rent Increase Compliance Toolkit includes a proof-of-service log and a pre-service compliance checklist that walks through every document you need before, during, and after delivery.
