Quebec Lease Modification Notice 2026 — New Rules Explained for Landlords
What Counts as a Lease Modification
In Quebec, any change to lease conditions at renewal — not just rent — requires a formal modification notice. A landlord who wants to increase the rent, change parking terms, add or remove a clause, or alter the lease duration must serve this notice within the statutory window. The rent increase is by far the most common modification, but the mechanism covers all lease terms.
The TAL's official form (TAL-806A-E, revision 2026-05) is titled Notice of rent increase and modification of another condition of the lease — the "and modification of another condition" part is intentional. You can serve one notice that covers both a rent increase and a non-monetary change (like adding a no-smoking clause), or a notice that covers only one.
The 2026 Formula at a Glance
For modification notices served on or after January 1, 2026 (covering renewal periods starting between April 2, 2026 and April 1, 2027), the TAL applies the modernized calculation criteria:
| Component | 2026 Rate |
|---|---|
| Base indexation (3-year Quebec CPI average) | 3.1% |
| Municipal/school tax increase | Excess above 3.1% only |
| Insurance premium increase | Excess above 3.1% only |
| Capital expenditure amortization | 5.0% per year (20-year spread) |
| Personal services (seniors' residences) | 6.7% |
The old grid with separate energy components (electricity, gas, heating oil) is gone. Energy cost changes are absorbed into the CPI-based 3.1% base rate.
These percentages are not mandatory caps — they are the criteria the TAL applies when adjudicating a disputed increase. If the tenant accepts your proposal without challenging it, the agreed amount stands regardless of the formula.
Notice Requirements Under the New Rules
The form requirements have not changed. The 2026 formula reform affected the calculation methodology, not the notice procedure. You still need:
- Full names of all lessors and lessees
- Complete civic address of the dwelling
- The proposed increase (as a new total, net increase, or percentage)
- The proposed renewal start and end dates
- The three prescribed response options (accept / refuse and stay / leave)
- Your signature and the date
The statutory service windows are also unchanged: 3 to 6 months before expiry for leases of 12 months or more, 1 to 2 months for shorter leases. For the standard July 1 lease, the notice must be received between January 1 and March 31.

What Actually Changed in Practice
The practical difference for landlords is in the calculation, not the procedure. Under the old system, you would look up six or seven separate component rates (base for unheated, electricity adjustment, gas adjustment, tax factor, insurance factor, capital rate) and add them together. Under the 2026 system, you start with one base rate and add specific excess adjustments only if your costs rose faster than inflation.
For most landlords whose operating costs are relatively stable, the calculation is simpler. One number (3.1%) handles the baseline. You only need to pull out tax bills and insurance statements if you believe the increases exceeded 3.1%. Capital work claims still require full invoice documentation.
The net effect varies by property. Some landlords will see a lower calculated increase than under the old system (because the excess-only treatment reduces the tax and insurance contributions). Others with volatile costs or significant capital work may see a higher figure (the 5% amortization rate is more generous than the 2025 legacy rate of 4.0%).
Non-Rent Modifications
If you want to change lease terms other than rent — adding a clause, changing the renewal duration, or modifying conditions about shared spaces — the same notice serves both purposes. Describe the non-monetary changes in the designated section of the TAL-806A-E form. The tenant has the statutory response options for the notice; the parties can also agree in writing to different lease terms.
