Quebec Rent Increase Evidence Dossier — What Documentation the TAL Expects
Why Your Evidence File Matters
When a tenant refuses your rent increase and you file an application for rent fixing at the TAL, the adjudicator applies the calculation criteria from the Règlement sur les critères de fixation de loyer to the documents you present. A claimed cost without supporting documents can be rejected — the TAL does not take your word for what you spent. The burden of proof sits with the landlord.
The 2026 modernized formula makes documentation especially critical because the tax and insurance components now use an excess-above-3.1% mechanic. You need to show not just that your costs rose, but by how much they rose relative to the baseline. Unsupported estimates or unexplained discrepancies can lead to expense entries being rejected.
The Four Categories of Evidence
Municipal and School Tax Bills
Bring the actual tax bills (or assessment notices) for the current and previous year. The TAL needs to see the dollar amounts to calculate whether the increase exceeds the 3.1% base rate. If your municipal taxes went from $3,200 to $3,400 — a 6.25% increase — the excess is $100.80 per year ($200 increase minus 3.1% of the prior $3,200 bill), before applying the target unit's share.
Keep both years' bills. A single year's bill is useless without the comparison year.
Building Insurance Statements
Same principle as taxes. Bring the insurance renewal statement showing the premium for the current policy period and the previous period. The TAL calculates the percentage change and adds only the portion exceeding 3.1%.
If your insurer changed mid-year and you have two policies that together cover the 12-month period, bring both. Gaps in coverage dates will create questions you want to answer before the hearing, not during it.
Capital Expenditure Invoices
Major repairs and capital improvements — roof replacement, window installation, structural masonry, unit modernization — are amortized at 5% per year under the 2026 formula. To claim this component, you need:
- Contractor invoices showing the work performed, the address, and the total cost (including applicable taxes)
- Proof of payment — cancelled cheques, bank statements, or credit card statements showing the payment cleared. An unpaid invoice does not qualify.
- Dates of completion — the work must have been completed during the preceding calendar year
The TAL deducts subsidies and insurance indemnities from the eligible amount. If your insurer covered $8,000 of a $22,000 roof repair, the amortizable base is $14,000. Bring the insurance claim settlement letter.
The distinction between capital work and routine maintenance matters. The TAL criteria describe major repairs and capital improvements such as roof replacement, structural masonry, window installation, and unit overhauls. Routine maintenance such as painting, cleaning, or minor repairs should not be assumed to qualify as capital work. When in doubt, keep the invoice anyway — let the adjudicator decide.
Proof of Service and Tenant Response
This isn't a calculation input, but it's part of your hearing file. Bring the copy of the notice you served (with the proposed increase), the proof of delivery (registered mail receipt, bailiff's procès-verbal, or signed acknowledgment), and the tenant's written refusal.
If any of these are missing, the tenant's lawyer can challenge the timeline. The TAL checks that you served within the 3-to-6-month window and filed your application within one month of the refusal.
Organizing the Dossier
Arrange documents chronologically by category. A simple four-tab folder works:
- Taxes (current and prior year)
- Insurance (current and prior year)
- Capital work (invoices + payment proof + completion dates)
- Notice and response chain (notice, proof of delivery, tenant refusal, TAL filing confirmation)
Number each exhibit and prepare a one-page summary listing every document with its date and dollar amount. The adjudicator reads dozens of files — making yours easy to follow helps.
