Redbridge Unlicensed Property Penalty: Fines, RROs and Prosecution
Letting without a licence in Redbridge is not a paperwork technicality — the council treats it as a priority enforcement matter, and tenants have their own routes to claim money back. The financial exposure from a single unlicensed property can easily exceed the cost of the licence itself by a factor of thirty.
Civil Penalties
Under Section 249A of the Housing Act 2004, Redbridge Council can issue civil penalties of up to £30,000 per offence as an alternative to criminal prosecution. The £30,000 ceiling applies per offence; the council determines the amount based on the circumstances.
The £30,000 ceiling is per offence. The council determines the amount based on the severity of the offence, the landlord's history of compliance, the level of financial gain from the unlicensed letting, and whether the landlord cooperated or obstructed the investigation.
Criminal Prosecution
Instead of a civil penalty, the council can prosecute in Magistrates' Court under Section 72(1) (HMO offences) or Section 95(1) (selective licensing offences) of the Housing Act 2004. A conviction carries an unlimited fine.
A conviction or civil penalty can also lead to entry on the national Database of Rogue Landlords and the imposition of a banning order under the Housing and Planning Act 2016, which prohibits the person from letting or managing residential property.
Rent Repayment Orders
This is the enforcement route tenants use directly. Under the Housing and Planning Act 2016, tenants or the council can apply to the First-tier Tribunal for a rent repayment order (RRO) to recover rent paid during the period of unlicensed operation.
For offences committed before 1 May 2026, the maximum RRO is 12 months of rent. For offences committed on or after 1 May 2026, the Renters' Rights Act doubled the cap to 24 months of rent. For a continuing offence spanning that date, the 24-month cap applies to rent paid from 1 May 2026 onward, while pre-May 2026 rent is capped at 12 months.
RRO liability extends beyond the immediate landlord to superior landlords and company directors. Tenants apply using Form RRO1 at the First-tier Tribunal (Property Chamber), and they don't need the council's involvement to file.
Public awareness of RROs has grown significantly. Tenants in Redbridge actively check the council's public register to confirm whether their property is licensed, and advice services like Shelter and Citizens Advice guide them through the RRO process.

The Section 21 Bar
Section 21 "no-fault" evictions were abolished on 1 May 2026 under the Renters' Rights Act, so the former Section 21 licensing bar is now historical. Before abolition, letting without a licence prevented a valid Section 21 notice from being served.
What Submission Does for You
Submitting a complete, valid licence application establishes a defence against the criminal offence of operating without a licence. The key word is "complete" — an abandoned portal draft that expired after 28 days does not count. The council treats a property as unlicensed until a full application (all documents uploaded, Part A paid, form submitted) is on record.
Once you've submitted, the application is under processing and the property is treated as having a pending licence. This doesn't protect you from RRO claims for the period before submission, but it stops new enforcement action from that point.
How to Respond If You're Already Unlicensed
The priority is to get a complete application submitted as fast as possible. Assemble the required documents — Gas Safety Certificate, EICR, PAT testing, EPC, floor plans — and apply through the online portal without delay. Every day without a valid application on record extends the period of exposure.
The Redbridge Landlord Licensing Guide includes a pre-application document tracker and an application submission log designed to get you from zero to submitted application as efficiently as possible, with a compliance record you can keep as evidence of when you applied.
