Rent Smart Wales Agent Licensing and Verification

Who Needs an Agent Licence

Any person or business carrying out letting or property management tasks on behalf of a landlord in Wales must hold a Rent Smart Wales agent licence. This applies to high-street letting agents, online property managers, and individuals who manage properties for relatives or friends for a fee.

The licensable activities are the same ones that trigger a landlord licence — arranging viewings, vetting tenants, preparing contracts, collecting rent, managing repairs, conducting inspections, and serving notices. The difference is that the agent is doing these on someone else's property.

Agent licence fees are graduated based on portfolio size and discounted for members of UKALA, ARLA Propertymark, RICS or Safeagent. The training requirement is longer than for landlords: 7.5 hours online (£60) or 7.5 hours classroom (£140).

Business Safeguards Agents Must Hold

Beyond training and the fit-and-proper declaration, commercial agents must maintain three business safeguards before RSW will grant or renew a licence:

Professional Indemnity Insurance (PII). Agents managing 100 properties or fewer need a minimum £100,000 cover. Portfolios above 100 properties require £500,000 minimum. The PII must be specifically tailored to lettings and property management — a generic business policy will not qualify.

Client Money Protection (CMP). If the agent handles tenant rent payments or tenancy deposits, they must hold certified CMP insurance. This protects tenants and landlords if the agent misappropriates or loses client funds through insolvency.

Approved Redress Scheme membership. Agents must be active members of either The Property Ombudsman (TPO) or the Property Redress Scheme (PRS). This gives tenants and landlords a dispute resolution route without going to court.

Family members managing fewer than five properties for a relative without collecting client fees may apply for formal exemptions from CMP requirements.

The Agent Audit Framework

RSW audits licensed agents during their five-year licence period. Audits examine tenant fee transparency, gas and electrical safety certificates, asbestos records, written terms of business, and client money accounting.

Audit results are graded:

  • Grade 1 (Urgent Action Needed): Critical failures — missing CMP, PII or redress, or missing safety certification. Triggers licence review or revocation
  • Grade 2 (Action Needed): Compliance gaps that must be fixed by a deadline
  • Grade 3 (Satisfactory): Compliant with minor recommendations
  • Grade 4 (Best Practice): Exemplary standards

A Grade 1 result can lead directly to licence revocation, which would leave every property the agent manages without licensed management coverage — exposing every landlord client to enforcement action.

How to Verify Your Agent

Before signing a management agreement with a letting agent in Wales, verify their credentials yourself. The RSW public register at rentsmart.gov.wales lets you search by agent name or licence number. Check:

  1. Active RSW licence — confirm the licence status is "active" and note the expiry date
  2. CMP coverage — ask the agent for their CMP certificate and verify with the scheme provider
  3. Redress scheme membership — confirm active membership with TPO or PRS
  4. PII — ask for evidence of current professional indemnity cover

Do this annually, not just at the start of the relationship. An agent whose licence or CMP lapses mid-contract leaves you exposed.

Linking and Unlinking Agents on the Portal

When you appoint an agent, you link their licence to your property on the RSW portal. The system sends the agent a notification, and they must log in and accept the link from their own account.

If you terminate an agent and switch to a new one (or move to self-management), you must update the portal within 28 days. The sequence matters: unlink the old agent and link the new one (or apply for your own landlord licence) without leaving a gap. During any period where no licensed entity covers management, you are non-compliant.

When changing agents, do not assume the old agent will update the portal on their behalf. The obligation to maintain accurate records is the landlord's.

Our Rent Smart Wales guide includes a dedicated agent verification log — a printable record of annual checks against each safeguard requirement, designed to demonstrate due diligence in any dispute or tribunal hearing.
