Rent Smart Wales Exempt Properties
The General Rule
Every landlord who owns a residential property in Wales that is rented out under a domestic tenancy (now called a standard occupation contract) must register with Rent Smart Wales. The exemptions are narrow and specific.
If you are unsure whether your arrangement qualifies, the safe default is to register. The £60 registration fee is trivial compared to the penalties for operating without registration — Fixed Penalty Notices of up to £150, prosecution with unlimited fines, and invalid Section 173 notices.
Properties That Are Exempt
The Housing (Wales) Act 2014 and its associated schedules exclude the following from the scope of domestic tenancies:
Resident landlords and lodgers. If you live in the same dwelling and rent a room to a lodger, that is not a domestic tenancy. The lodger does not have exclusive possession of a self-contained dwelling — they share your home. This exemption only applies if the property is genuinely your primary residence.
Holiday lets. Properties let strictly as short-term holiday accommodation are excluded. This means properties marketed and operated purely for leisure stays, not for anyone's permanent or semi-permanent home. The distinction turns on the nature of the occupation: a holiday cottage booked for weekend breaks is exempt; a furnished flat let on rolling monthly agreements to someone who lives there full-time is not, regardless of what the owner calls it.
Student accommodation by institutions. Halls of residence or university-managed housing provided directly by a higher education institution or a registered social landlord do not fall under Part 1. Private student lets (a landlord renting a house to students) are not exempt — only accommodation operated by the institution itself.
Social housing. Properties owned and managed by local housing authorities or Registered Social Landlords regulated by the Welsh Government sit outside the private-sector registration regime.
Non-permanent structures. Mobile homes, caravans, and temporary structures that are not classified as permanent residential dwellings are excluded.
The Short-Term Let Grey Area
Short-term lets in Wales sit in evolving regulatory territory. As of 2026, a property let exclusively for holiday purposes is exempt from Rent Smart Wales. However, if you mix holiday lets with longer residential lets — renting on Airbnb in summer but to a resident tenant during winter — the residential periods trigger the registration requirement.
The Welsh Government is also developing a separate licensing framework for visitor accommodation under the Development of Tourism and Regulation of Visitor Accommodation (Wales) Bill. This will introduce its own registration requirements for short-term and holiday lets. Owning a holiday let does not necessarily mean zero regulatory obligations — it means Rent Smart Wales specifically does not apply.

Common Misunderstandings
"I only have one property." Portfolio size is irrelevant. One property triggers the same obligation as one hundred.
"I live in England." Your personal address does not determine the obligation. If the property is in Wales, Welsh rules apply regardless of where you live.
"My property is empty between tenants." Registration persists during void periods if the property is intended for residential rental. You do not deregister during a vacancy and re-register when a new tenant moves in.
"I have an HMO licence from the council." Local authority HMO licensing (under the Housing Act 2004) is a completely separate regime. Holding a council HMO licence does not satisfy your Rent Smart Wales registration or licensing obligations, and vice versa. You need both if both apply.
