Section 11 Notice Scotland: Landlord's Duty to Notify the Council

When you apply to the First-tier Tribunal to evict a tenant in Scotland, you have a separate legal duty to notify the local council at the same time. This is the Section 11 notice — a requirement under Section 11 of the Homelessness etc. (Scotland) Act 2003 that catches landlords out because it sits outside the main notice-to-leave process. The form and manner are prescribed by the Notice to Local Authorities (Scotland) Regulations 2008 (SSI 2008/324).

What the Section 11 Notice Does

It alerts the local authority's homelessness or housing options team that a tenant may lose their home. The council uses this to reach out to the tenant and offer housing support before they become homeless.

It's not a form you serve on the tenant. It's a notification you send to the council.

When to Serve It

Serve the Section 11 notice at the point you lodge your Form E eviction application with the Housing and Property Chamber. Not before, not after — simultaneously.

A common mistake is serving it when you issue the notice to leave. That's too early. The statutory trigger is the lodging of the tribunal application, not the service of the notice to leave.

Who Receives It

The Section 11 team at the local authority where the property is located. Each of Scotland's 32 councils handles this differently:

  • Some have a dedicated Section 11 email address
  • Some require a downloadable form sent by post
  • Some accept it through an online housing portal

Check your local council's website under "homelessness" or "housing options" for the correct contact. If you can't find it, phone the council's housing department directly.

What to Include

Use the prescribed notice form and gather these details for it:

  • Your name and contact details as the landlord
  • The tenant's name and the property address
  • Confirmation that you've lodged an eviction application with the tribunal
  • The ground(s) you're relying on
  • The date you lodged Form E

Local authorities may provide a template based on the prescribed form. Follow the statutory form and the council's submission instructions; an informal letter is not a substitute.

Proof for the Tribunal

The tribunal expects evidence that you've complied with Section 11. Keep:

  • A copy of the notice you sent
  • Proof of transmission — postal receipt, email sent confirmation, or online submission reference
  • The date you sent it

Include this in your Form E evidence package. A valid Section 11 notice is a precondition to an eviction application under Section 56 of the Private Housing (Tenancies) (Scotland) Act 2016; a defective or missing notice can lead the Tribunal to reject the application.

What Happens If You Don't Serve It

Section 11 is a statutory duty, not optional. Section 56 of the Private Housing (Tenancies) (Scotland) Act 2016 prevents a landlord from applying for an eviction order unless a valid notice has been given to the local authority. Complete this step when you lodge Form E and keep proof of transmission.
