Council Tax on HMOs in Sheffield: Who Pays and How Exemptions Work

Who Pays Council Tax on a Sheffield HMO?

On a standard single-household let, the tenants are liable for council tax. On an HMO — where the property is occupied by people from separate households who share facilities — the rules are different. The landlord is the liable person for council tax on an HMO, not the individual tenants. This applies to every mandatory HMO in Sheffield: if the property meets the five-person, two-household test and requires a licence, the council tax bill comes to the landlord.

Section 6 of the Local Government Finance Act 1992 sets out the general council tax liability hierarchy. The Council Tax (Chargeable Dwellings and Liability for Owners) (Amendment) (England) Regulations 2023, in force from 1 December 2023, expanded the owner-liability rules so the owner is liable for council tax on an HMO as defined by Section 254 of the Housing Act 2004.

The Student Exemption

A property occupied entirely by full-time students is exempt from council tax under Class N of the Council Tax (Exempt Dwellings) Order 1992. If every occupant of a Sheffield HMO is a full-time student — typically at the University of Sheffield or Sheffield Hallam University — the property qualifies for a full exemption and no council tax is payable by anyone.

The key word is "entirely." If one occupant is not a full-time student — a part-time student, a working partner or a non-student subtenant — the all-student exemption no longer applies. Sheffield says a student-related discount may still apply depending on how many residents qualify; no reduction is allowed when two or more people in the property are not qualifying students. Students must provide evidence of their full-time status to the council (usually a council tax exemption certificate from their university).

For 2026/27, the standard Sheffield charges before parish precepts are £1,670.22 for Band A and £2,505.32 for Band D. Bradfield, Ecclesfield and Stocksbridge add their own parish charges. On a student let that loses its exemption because an occupant does not qualify, the charge falls to the liable person.

How Landlords Handle the Cost

Most HMO landlords in Sheffield who are liable for council tax build it into their rent calculations. The rent for each room reflects the all-inclusive cost of occupancy, including the landlord's council tax liability. This is standard practice and tenants generally expect it — they know they are not individually billed.

Where landlords run into trouble is failing to budget for the liability at the outset. The 2026/27 basic charge for Band C is £2,226.95 before any parish precept. If the landlord set rents on the assumption that tenants would pay (as they would on a single-household let), that cost comes as an unpleasant surprise.

Mixed-Use and Conversion Complications

Properties that are partly commercial and partly residential — such as a shop with flats above — may have separate council tax assessments for the residential elements and a business rates assessment for the commercial part. The HMO rules apply to the residential units if they meet the occupancy threshold.

Properties undergoing conversion from C3 (dwellinghouse) to C4 (small HMO) or Sui Generis (large HMO) can face transitional complications with council tax banding. Sheffield City Council's Valuation Office may reassess the property's council tax band after a change of use, particularly if the conversion created additional bedrooms or altered the property's layout substantially.

If you are converting a property and expect the council tax band to change, factor the potential increase into your financial projections before committing to the works — especially alongside the cost of planning permission under Sheffield's Article 4 Direction and the HMO licence fees.

Discounts and Reductions

If an HMO is unoccupied between tenancies — during summer voids on student lets, for example — the landlord may qualify for an empty property discount. Sheffield's empty property discount rules and any premium charges for long-term empty dwellings are set annually by the council. Check directly with Sheffield City Council's council tax team for the current rates; these change more frequently than licensing rules.
