Sheffield Fit and Proper Person Test for HMO Landlords

Every proposed licence holder and property manager named on a Sheffield HMO licence application must complete a Fit and Proper Person declaration. This is not a formality — the council can refuse a licence entirely if either person fails the test.

What the Council Checks

Sheffield City Council evaluates whether the applicant has:

  • Criminal convictions involving fraud, dishonesty, violence, drugs or sexual offences
  • Findings of unlawful discrimination under equality legislation
  • Prior breaches of housing law, including civil penalties served under Housing Act enforcement powers
  • Housing benefit fraud or related financial offences
  • A documented history of property management failures relevant to the council's assessment

The check covers both the proposed licence holder (usually the property owner) and every proposed manager. If a letting agency manages the property, the agency principal or designated individual must be named as manager and pass the same test.

The Declaration Form

The standard HMO application form includes a Fit and Proper declaration section. If the property has more than two licence holders or managers, an Additional Fit and Proper Declaration Form must be submitted for each extra person.

The declaration asks you to disclose:

  • Unspent criminal convictions (and in some cases spent convictions relevant to housing offences)
  • Any current or past civil penalty notices or prosecution under the Housing Act
  • Enforcement action taken by any local authority, not just Sheffield
  • Whether you have been refused an HMO licence elsewhere
  • Whether you are subject to a banning order under the Housing and Planning Act 2016

Deliberately omitting or falsifying information on the declaration is itself an offence that can lead to licence refusal, prosecution, and a banning order.

Who Is the "Most Appropriate" Licence Holder?

The Housing Act 2004 says the licence must be held by the person "most appropriate" — typically the freeholder or the individual receiving rental income. In practice, this means:

  • Sole owner who self-manages: the owner is both licence holder and manager
  • Joint ownership (married couple or partners): one owner holds the licence; the other may be named as manager
  • Owner using a letting agent: the owner holds the licence; the agent or their designated individual is the manager
  • Corporate ownership: the company is the licence holder; a named individual director or employee is the manager

The licence holder must maintain a valid correspondence address in England or Wales for service of legal notices. A PO Box is acceptable; an overseas-only address is not.

What Happens If You Fail

If the council determines that the proposed licence holder or manager is not a fit and proper person, it may refuse the application.

You can appeal a refusal to the First-tier Tribunal (Property Chamber) within 28 days. But the appeal process takes months, and in the meantime you cannot lawfully let the property as a licensable HMO.

The cleaner approach is to get the declaration right at submission. The Sheffield landlord licensing guide walks through the fit-and-proper requirements, the disclosure questions, and the common pitfalls that delay or derail applications.
