Do I Need an HMO Licence in Southampton?
You've heard Southampton has licensing rules for shared houses, and now you're trying to figure out whether your property actually needs one. The answer depends on three things: how many people live there, whether they form separate households, and which ward the property sits in.
The Two-Question Test
Start with the total number of occupants. Count every person who uses the property as their only or main home — tenants, lodgers, and live-in partners who aren't on the tenancy all count. Children count too.
Next, count how many separate households those people form. Under the Housing Act 2004, a household is a single person or members of the same family (married couples, cohabiting partners, parents and children, siblings). Two friends sharing are two households. A couple sharing with an unrelated flatmate is two households.
If your property has five or more people from two or more households sharing a kitchen, bathroom or toilet, it needs a mandatory HMO licence — regardless of where in Southampton it sits. This applies citywide.
If the property has three or four people from two or more households sharing facilities, the answer depends on your ward.
Which Wards Require an Additional Licence?
Southampton's Additional HMO Licensing Scheme covers nine wards: Banister & Polygon, Bargate, Bassett, Bevois, Freemantle, Millbrook, Portswood, Shirley, and Swaythling. The scheme came into force on 1 October 2025 and runs until 30 September 2030.
If your three- or four-person shared property falls within one of those wards, it needs an additional HMO licence. Outside those nine wards, a property with three or four sharers doesn't need a licence.
Not sure which ward your property is in? The Southampton City Council website has a ward finder tool, or you can check the council's interactive boundary map using your postcode.
Common Situations That Catch Landlords Out
Resident landlords with lodgers. If you live in the property yourself and take in up to two lodgers, you're exempt under Schedule 14 of the Housing Act 2004. Take on a third lodger in one of the nine designated wards and you'll need an additional HMO licence.
Purpose-built flats. National mandatory licensing excludes purpose-built flats in blocks of three or more self-contained flats. But Southampton's additional licensing scheme deliberately captures these — a purpose-built flat in the nine wards with three or four sharers from separate households still needs a licence.
Joint tenancies. Four friends sign one joint tenancy agreement. Because they're four separate households, the property is an HMO of four occupants. In a designated ward, that's licensable.
Single-family lets. A couple renting a two-bed house are one household. No licence needed. A family of five are still one household — one household can never be an HMO, regardless of headcount.

Properties Outside Both Schemes
If your property is a single-household let, or a two-person share, or a three-person share outside the nine designated wards, no HMO licence is needed under current Southampton rules. There's no selective licensing scheme in Southampton as of late 2026.
That said, landlords of assured and regulated private tenancies in the South East — including those without a licensing obligation — will need to register on the national PRS Database from 15 March 2027 and complete registration by 14 June 2027 under the Renters' Rights Act.
What to Do Next
If your property does need a licence, the application goes through Southampton City Council's online portal. The standard fee for an additional HMO licence is £953, though landlords who use an approved independent surveyor pay £636 — saving £317. Late applications (filed more than three months after the property became licensable) cost £1,618.
