Southampton Student HMO Licence: What Landlords Need to Know
Student houses are a large part of Southampton's private rented sector, particularly in wards like Portswood, Swaythling and Bassett around the University of Southampton and Bevois near Solent University. Most student shared houses need an HMO licence — the question is which scheme applies and whether any exemptions help.
When a Student House Needs a Licence
The licensing rules do not distinguish between student tenants and any other occupants. What matters is the number of people, the number of households they form and whether they share facilities.
Each individual student counts as a separate household unless they are related. Five students from five different families sharing a house form five households — that triggers mandatory HMO licensing citywide. Three or four unrelated students sharing a house in one of the nine additional-licensing wards (Banister and Polygon, Bargate, Bassett, Bevois, Freemantle, Millbrook, Portswood, Shirley or Swaythling) need an additional HMO licence.
A couple who are students count as one household. Three students who are siblings also count as one household. The headcount and household count both matter.
The University Exemption
Under Schedule 14 to the Housing Act 2004, properties managed or controlled by educational establishments operating under an approved national code of management are exempt from both mandatory and additional HMO licensing. This covers university-operated halls of residence and accommodation managed directly by the University of Southampton or Solent University under such codes.
Private landlords renting to students do not benefit from this exemption. It applies to the institution, not to the student. A privately owned house let to five students on a joint tenancy needs a mandatory HMO licence even if all five attend the University of Southampton.
The ANUK Discount
Large student accommodation blocks managed by members of the Accreditation Network UK (ANUK) National Code of Standards for Larger Developments qualify for a 50% reduction on Southampton's HMO licence fees. This brings the fee down significantly — roughly £477 instead of £953 at the standard rate.
This discount is relevant mainly to purpose-built student accommodation operators and large-scale providers, not to individual landlords letting a single converted house. If you manage a qualifying block, check with the council whether the discount applies to your specific arrangement.

Student Lets and the Additional Licensing Wards
Southampton's nine additional-licensing wards were designated partly because of HMO concentration driven by the student rental market. Portswood and Swaythling are traditional student areas for the University of Southampton. Bevois and Bargate serve Solent University students. Bassett, Freemantle and Shirley have seen growing student demand as rents in core areas rise.
A three-bedroom student house in Portswood needs an additional HMO licence. The same house in Lordshill does not — it is outside the nine wards and below the five-person mandatory threshold.
This ward-by-ward difference catches landlords who own properties in multiple parts of the city. A property that needs no licence in one ward absolutely needs one in another, with the same number of tenants.
Turnover and Reletting
Student tenancies typically turn over annually, with new groups moving in each September. Each reletting is a compliance checkpoint. The licence conditions — maximum occupancy, room sizes, safety certificates — must still be met for the new tenants. If the outgoing group had four students and the incoming group has five, the property might cross the threshold from additional to mandatory licensing, which could require a new application.
Keep safety certificates current through the academic cycle. A gas safety record that was valid when the previous group moved in might expire mid-tenancy for the next group.
