Sunderland HMO Room Sizes: Minimum Standards and How They're Measured

Room sizes in a licensed Sunderland HMO aren't advisory. They're written into your licence document, and letting a bedroom that falls below the minimum is a breach of licence conditions — carrying a civil penalty of up to £40,000.

The National Minimums

Sunderland City Council enforces the national statutory minimum room sizes set by Part 2 of the Housing Act 2004 and the Licensing of Houses in Multiple Occupation (Mandatory Conditions of Licences) (England) Regulations 2018:

Bedroom type Minimum floor area
Single adult (over 10 years old) 6.51 m²
Double adult (over 10 years old) 10.22 m²
Child under 10 4.64 m²
Prohibited as a bedroom Below 4.64 m²

Any room under 4.64 m² cannot be used as sleeping accommodation under any circumstances. This is an absolute prohibition — not a discretion the council exercises, but a mandatory licence condition.

The 1.5-Metre Ceiling Rule

The floor area calculation excludes any part of a room where the ceiling height is below 1.5 metres. In Sunderland's older terraced housing stock, attic conversions and rooms with sloping ceilings are common — and this rule bites hard.

A loft bedroom might measure 12 m² wall to wall, but if a third of the floor area sits under a sloping ceiling below 1.5 metres, the usable floor area is only 8 m². That room qualifies as a single bedroom (above 6.51 m²) but not a double.

Council housing officers bring tape measures to inspections and will verify your floor plan dimensions against the physical room. If the measurements don't match, or if the ceiling-height deduction wasn't accounted for, you'll face an incomplete-application surcharge at best and a licence condition breach at worst.

Amenity Ratios

Beyond bedroom sizes, Sunderland enforces minimum amenity ratios for shared facilities:

  • Bathrooms: Minimum of one bathroom and separate WC per five occupants
  • Kitchen facilities: Adequate worktop space, sinks, food storage, and cooking appliances for the total permitted occupancy

These ratios are assessed during the property inspection and written into the licence conditions. If your property has six occupants and one bathroom, the maths works. Seven occupants and one bathroom, and the council may require a second bathroom or reduce the permitted occupancy.

How the Inspection Works

After you submit your HMO licence application, Sunderland City Council sends a housing standards officer for a physical inspection. They're assessing the property against the 21 potential hazards under the Housing Health and Safety Rating System (HHSRS), but the room size and amenity checks are central.

The officer will:

  • Measure every bedroom and compare against your submitted floor plans
  • Check ceiling heights in rooms with slopes, eaves, or low sections
  • Verify that fire doors, smoke detectors, and heat detectors are positioned as shown on your plans
  • Inspect shared kitchen, bathroom, and sanitary facilities against the amenity ratios
  • Assess for damp, mould, excess cold, electrical hazards, and structural issues

If Category 1 or serious Category 2 hazards are found, the council can issue an Improvement Notice or Prohibition Order, which carries an administrative charge of £600 in 2026/27.

Getting Your Floor Plans Right

Your floor plans are the document the council checks your room sizes against. Every sleeping room needs its floor area annotated in square metres, with the ceiling-height deduction already applied if relevant. The council's portal expects precise measurements, not approximations.

The Sunderland Landlord Licensing Guide includes a spatial audit worksheet and floor plan annotation reference — the measurements and markings that match what the council's officers expect to see when they arrive.
