Middlesbrough HMO Room Sizes — Minimum Bedroom and Amenity Standards
If you operate a licensed HMO in Middlesbrough, every bedroom must meet national mandatory minimum floor areas. Getting this wrong is a criminal offence — permitting a room below the minimum to be used as sleeping accommodation exposes you to civil penalties of up to £40,000.
The Mandatory Minimums
Under the Licensing of Houses in Multiple Occupation (Mandatory Conditions of Licences) (England) Regulations 2018, these are the minimum clear usable floor areas for sleeping rooms in any licensed HMO in Middlesbrough:
| Room type | Minimum floor area |
|---|---|
| Single adult (1 person aged 10+) | 6.51 m² |
| Double adult (2 persons aged 10+) | 10.22 m² |
| Child (1 person under 10) | 4.64 m² |
These are the national standards and they apply to every licensed HMO in the borough, including both mandatory HMOs (five or more occupants from two or more households) and smaller HMOs within the Newport selective licensing area.
The Headroom Exclusion Rule
Not every square metre of floor space counts. Any part of a room where the ceiling height is less than 1.5 metres cannot be included in the minimum floor area calculation. This is particularly relevant for attic conversions and rooms under sloping roofs, which are common in Middlesbrough's Victorian terraces. A room that looks spacious on a floor plan might fall below the minimum once you exclude the low-headroom wedges along the eaves.
When preparing scale floor plans for your licence application — required for all HMOs — you need to mark the clear usable floor area excluding any sub-1.5m sections.
Kitchen and Bathroom Ratios
Beyond bedrooms, licensed HMOs must provide adequate shared facilities. The baseline guidance under Schedule 3 of the Housing Act 2004 requires:
- Bathrooms: a minimum of one dedicated bathroom with a fixed bath or shower and toilet for every five occupants sharing facilities
- Separate WC: where five or more occupants reside, a separate WC with a wash-hand basin is needed in addition to the main bathroom
- Kitchens: an adequate number of cooking rings, ovens, sinks, impervious worktops (minimum 1,000 mm × 600 mm), and refrigerated food storage units suitable for the occupant headcount
For a five-person HMO, this typically means at least one full bathroom, one separate WC, and kitchen facilities sized for five adults. Six or more occupants may trigger additional bathroom requirements.

How Middlesbrough Council Checks
During a licence application and subsequent inspections, Middlesbrough Council's Private Sector Housing Team assesses room dimensions against these standards. They also conduct Housing Health and Safety Rating System (HHSRS) inspections covering 29 statutory hazards — damp and mould, excess cold, fire risks, structural falls, and more.
If a bedroom is found to be below the minimum, the council will attach a condition to your licence specifying the maximum permitted occupancy for that room, or may require that the room not be used for sleeping at all. Ignoring such a condition is a breach of licence conditions carrying penalties up to £40,000.
Measuring Your Rooms
Use the room's clear usable floor area. Any part where the ceiling height is below 1.5 m must be excluded from the minimum-area calculation. Show the measured area and headroom on the scale plan; if the layout is unusual, confirm the council's measurement method before relying on the figure. If the area falls below 6.51 m² for a single-adult room, that room cannot be used as sleeping accommodation in a licensed HMO.
