Tenant Notice to Quit a Periodic Tenancy in England
Under the assured periodic tenancy framework that replaced ASTs on 1 May 2026, tenants in England can end a tenancy at any time by giving at least two months' written notice. There is no fixed term to wait out and no break clause to invoke. The notice right is statutory and cannot be contracted away.
The Two-Month Minimum
The tenant must provide a minimum of two full calendar months' notice in writing — by letter, email, or any other electronic means the landlord has agreed to accept. The notice must be addressed to the landlord's service address as stated in the Section 16D Written Statement of Terms or under Section 48 of the Landlord and Tenant Act 1987.
A verbal notice over the phone or in person does not count. Even if you trust the tenant and want to be flexible, insist on written confirmation so both sides have a clear record of the date.
Rent Period Alignment
The notice expiry date must fall at the end of a rent period — the day before rent is next due, or on the rent due date itself. This alignment rule catches landlords and tenants off guard regularly.
If rent is due on the 1st of every month and the tenant serves notice on 15 June 2026, two calendar months lands on 15 August. But that falls mid-period. The earliest valid expiry date is 31 August 2026 — the last day before the next rent due date. In practice, the tenant often ends up giving slightly more than two months.
For weekly tenancies, the same principle applies but with shorter cycles. The notice must still be at least two months and must expire at the end of a rent week.
What the Landlord Should Do When Notice Is Received
Acknowledge the notice in writing. Confirm the expiry date and check that it aligns with the rent period. If the proposed date falls mid-period, let the tenant know what the correct expiry date would be — they may have miscalculated.
Start your end-of-tenancy planning: schedule a checkout inspection, arrange for the deposit return process through your protection scheme, and update your property management calendar. You are not obligated to re-let immediately, but the clock is ticking on your void period.
If you have a Section 13 rent increase pending that would take effect after the notice expiry, it lapses with the tenancy. Plan accordingly.

Can the Tenant Leave Earlier by Agreement
Yes. The landlord and tenant can agree in writing to end the tenancy on an earlier date or with a shorter notice period. Both parties must consent — the landlord cannot impose a shorter period, and neither can the tenant leave early without agreement. Where joint tenants are involved, every named joint tenant must also agree to any variation.
A deed of surrender is the cleanest mechanism for an agreed early end. Both the landlord and all tenants sign it, specifying the exact date the tenancy terminates.
What Happens If the Tenant Just Leaves
If the tenant abandons the property without giving proper notice, the tenancy does not end automatically. You should attempt to contact the tenant in writing, document the abandonment, and — if they are truly gone and not responding — follow the process for recovering possession. Changing the locks without a court order risks a claim for unlawful eviction.
If the tenant stops paying rent but remains in the property, you pursue possession through the applicable Section 8 grounds, including Ground 8 for serious rent arrears, subject to its statutory threshold and notice requirements.
Tracking Notice Dates
With rolling periodic tenancies and no fixed end dates to anchor your planning, keeping a clean log of notice dates and rent period alignment becomes essential. The Assured Periodic Tenancies compliance kit includes a joint tenancy notice tracker that calculates valid expiry dates and logs the audit trail.
