Wales Landlord Fitness for Human Habitation Requirements
What the Fitness Standard Means in Wales
Sections 91 and 92 of the Renting Homes (Wales) Act 2016, together with the Renting Homes (Fitness for Human Habitation) (Wales) Regulations 2022, require that every dwelling let under an occupation contract must be fit for human habitation on the occupation date and throughout the entire contract term.
This is not a vague aspiration. The regulations define specific physical and documentary standards that a dwelling must meet. A property that falls short on any of them is statutorily deemed unfit — and the consequences for the landlord are immediate and financial.
The Specific Requirements
Interlinked smoke alarms. Mains-powered interlinked smoke alarms must be installed on every storey of the dwelling. Battery-only alarms and non-interlinked mains alarms do not comply. When one alarm sounds, all alarms in the dwelling must sound simultaneously.
Carbon monoxide alarms. A carbon monoxide alarm must be installed in every room containing a gas, oil or solid-fuel burning appliance. This includes rooms with a gas boiler, gas fire, wood-burning stove or oil heater.
Electrical Installation Condition Report (EICR). A valid EICR must be on file, with inspections at intervals of no more than 5 years or sooner if the previous report specifies a shorter interval. The report must be provided to the contract-holder within 14 days of the occupation date. C1, C2 or FI items make the installation unsatisfactory and need immediate attention; the landlord should arrange any required remedial work.
Gas Safety Certificate. A current Gas Safety Certificate covering every gas appliance, flue and fitting in the dwelling must be delivered before the occupation date. The annual inspection must be completed and each subsequent certificate provided within 28 days of inspection.
Energy Performance Certificate (EPC). A valid EPC must be available when the dwelling is marketed, and a copy must be provided to the contract-holder at the start of the contract under the Energy Performance of Buildings (England and Wales) Regulations 2012. Most private rental properties must achieve at least rating E under the Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015; a property rated F or G may be let only where a valid exemption is registered on the PRS Exemptions Register.
What "Unfit" Means for Rent
A dwelling that is deemed unfit for human habitation has a direct impact on rent collection. The contract-holder is not liable to pay rent for any day or part-day during which the dwelling remains unfit.
If the landlord disputes whether the dwelling was unfit, the Court determines whether the landlord met the fitness obligation; the contract-holder may have to repay rent if the Court finds that the dwelling was fit.

The Transition Deadlines
When the fitness regulations first came into force, converted occupation contracts (pre-December 2022 tenancies) were given a transitional grace period. The transitional period ran through 30 November 2023; full compliance with the EICR and interlinked smoke-alarm requirements was required from 1 December 2023.
Any converted contract that still does not have a compliant EICR or interlinked alarms is now in breach. There is no further grace period — compliance was due more than two years ago.
How Fitness Intersects with the Written Statement
The fitness-for-human-habitation requirements run alongside the written statement obligation, not instead of it. A landlord who delivers a complete written statement on Day 1 but lets a dwelling without interlinked smoke alarms has a fitness breach from the occupation date. The contract-holder is not liable for rent during any period when the dwelling is unfit; the written statement duty remains separate.
Conversely, a dwelling that meets every fitness standard but lacks a written statement still triggers the Section 87 compensation mechanism. Both obligations must be met independently.
Practical Steps
Before the occupation date:
- Install interlinked mains-powered smoke alarms on every storey.
- Install carbon monoxide alarms in every room with a relevant appliance.
- Commission an EICR when the current report's testing interval ends, no later than 5 years after the previous inspection.
- Obtain a current Gas Safety Certificate.
- Confirm the EPC meets the minimum E rating or that a valid exemption is registered.
Keep copies of all certificates and installation receipts. Provide the Gas Safety Certificate and EPC before occupation, and provide the EICR copy within 14 days of the occupation date.
