Wales Occupation Contracts Guide — Renting Homes Rules for Landlords

You downloaded the free model written statement from gov.wales. Now what?

Every private landlord in Wales must deliver a completed written statement to their contract-holder within 14 days of the occupation date. Miss that deadline and Section 87 of the Renting Homes (Wales) Act 2016 kicks in: one day's rent in statutory compensation for every day the statement is late, up to a maximum of two months' rent, plus statutory interest. No warning, no grace period — the clock starts the day your contract-holder moves in.

The Welsh Government provides model written statements for free. They are 40-page legal frameworks with blank fields, statutory cross-references, and no instructions. Which model do you need — periodic standard or fixed-term standard? Which terms can you vary and which are locked by statute? How do you prove the contract-holder actually received the statement on day 12, not day 15? The model does not tell you. Neither does the Rent Smart Wales portal, the legislation itself, or any of the 22 local council websites.

That gap is where landlords get hurt. The Written Statement Compliance System inside this guide turns a raw government download into a structured, end-to-end compliance process — from the pre-contract checks through to a signed, auditable delivery receipt that defends you if the contract-holder disputes timing.

What's Inside

  • Contract Type Decision Framework — Periodic standard or fixed-term standard? The framework maps your circumstances — reoccupation plans, rent certainty, notice flexibility — against the operational consequences of each contract type, including the six-month no-fault notice restriction under section 173 and the automatic periodic conversion at fixed-term expiry under section 184. You select the right structure before you touch the model statement.
  • Written Statement Completion Walkthrough — Field by field through the Welsh Government model written statement: Key Matters (names, address, occupation date, rent), Fundamental Terms you cannot alter, Supplementary Terms you can vary by agreement, and Additional Terms you can add. Every field is explained in plain language with the statutory reference alongside it.
  • Term Classification Matrix — A single-page reference that categorises every term in the model written statement as Fundamental (immutable — set by statute), Supplementary (default, alterable by written agreement between the parties), or Additional (custom clauses you draft yourself). Before you add a pet policy, a parking clause, or a garden-maintenance obligation, the matrix tells you whether it conflicts with a Fundamental Term.
  • 14-Day Delivery Compliance Protocol — The statutory delivery methods (personal delivery, recorded post, electronic transmission with prior written consent), the proof-of-service requirements for each method, and a dated receipt log that records the delivery date, method, and contract-holder acknowledgment. If a Section 87 compensation claim lands, this log is your defence.
  • Agent Handover Verification Procedure — Your letting agent executes the day-to-day management, but statutory liability for the written statement sits with you. This procedure gives you a structured audit checklist to verify that your agent has issued the correct model statement, completed every mandatory field, delivered it within the 14-day window, retained proof of service, and protected the deposit.
  • Joint Contract-Holder and Succession Reference — How joint contract-holders are added or withdrawn, the succession rights that apply when a contract-holder dies, and the written statement obligations that follow each change. Most template packs ignore these scenarios entirely.
  • Penalty Calculations and Enforcement Reference — What triggers statutory compensation, how the daily rate is calculated, the two-month cap, the separate deposit-protection penalties (one to three times the deposit amount), and the Rent Smart Wales enforcement escalation from Fixed Penalty Notices to prosecution.
  • Compliance Checklist — A two-page dated checklist covering every step from Rent Smart Wales registration through to ongoing obligations: safety certificates, deposit protection, anti-discrimination terms (sections 54A and 54B, mandatory since 1 June 2026), and the written statement cycle at fixed-term expiry. Print it, tick each item, file it with the property records.

Who This Guide Is For

  • First-time landlords in Wales who need to issue a standard occupation contract before a new letting begins
  • Accidental landlords who inherited a property or kept a former home as a let and discovered the Renting Homes rules apply to them
  • Landlords whose fixed-term contract is expiring and who need to issue a new periodic standard written statement within 14 days of the periodic contract commencing
  • Landlords switching from a managed agent to self-managing who need to audit the compliance file their agent assembled
  • Landlords who issued a written statement in 2022 or 2023 and need to confirm it includes the anti-discrimination terms that became mandatory on 1 June 2026
  • Joint owners who need to understand how joint contract-holder provisions affect the written statement

Who This Guide Is Not For

  • Tenants or contract-holders looking for advice on their rights — Shelter Cymru and Citizens Advice Cymru are the right first stop
  • Landlords seeking legal advice on a specific dispute or possession claim — this guide covers compliance process, not litigation strategy
  • Landlords in England — English tenancies are governed by separate legislation, including the Renters' Rights Act
  • Short-term let or holiday let operators whose arrangements fall outside the Renting Homes regime

Why Not Just Use the Free Government Templates?

The Welsh Government model written statements are freely available from gov.wales. They are the documents you will complete. What they are not is a preparation tool. The model statement is 40 pages of statutory text with blank fields and no guidance on which fields to complete, which terms you can customise, or how to prove the document was delivered on time.

Competitors sell occupation contract template packs — editable DOCX files with the same model statement terms pre-loaded. What those packs lack is the decision framework, the term classification, and the delivery audit trail. You get a document to fill in but no system to fill it in correctly, no method to prove it was delivered within the statutory window, and no reference to tell you which clauses you can modify without triggering enforceability problems.

This guide provides the system around the document. The Term Classification Matrix alone prevents the most common customisation mistake: adding a clause that contradicts a Fundamental Term, rendering the modification void. The 14-Day Delivery Compliance Protocol prevents the most expensive mistake: failing to prove timely service and facing a compensation claim that can reach two months' rent.
