One Miscounted Day and Your Notice Is Worthless

You need to end a tenancy. The rules changed on 30 January 2025 — the 90-day no-cause notice is back, and several notice periods dropped to 42 days. That sounds simpler. It isn't.

The Tenancy Tribunal still throws out notices that are short by a single calendar day. A letterbox delivery adds 2 working days of deemed receipt. Post adds 4. An email sent at 5:01 PM shifts deemed receipt to the next working day. Your notice period starts the day after deemed receipt — not the day you sent it. Get the count wrong and the Tribunal will dismiss your application, your tenant stays, and you start again from scratch.

If you are selling and the settlement date is locked in, a dismissed notice means interest penalties or default under the sale agreement. If a fixed term is expiring, missing the 21-day cutoff rolls the tenancy over to periodic and you lose control of the timeline entirely.

The Notice Compliance System

This is not a bare notice template with empty date fields. It is a complete compliance system that takes you from "I need to end this tenancy" through to a valid notice, a defensible proof-of-service file, and — if the tenant stays — a Tribunal-ready evidence pack.

Tenancy Services provides free notice forms. Those forms do not calculate your deemed-receipt date, do not tell you which notice is available for your ownership structure, do not warn you about the trust trap on 42-day notices, and do not prepare you for a possession order hearing. The Notice Compliance System fills every gap between the government's blank form and a notice that actually survives the Tribunal.

What's Inside the Guide

  • Decision route map — which notice route is available for your tenancy type, ownership structure, and situation, so you never serve a notice the Tribunal will reject on eligibility alone
  • Service date calculations for every delivery method — hand delivery, letterbox, post, and electronic service, with the deeming rules, working-day exclusions, and public holiday checks built in
  • The trust and company ownership trap — why the 42-day owner-occupation notice fails when the property is held by a trust or company, and the alternative routes that work
  • Fixed-term non-continuation window — the 90-to-21-day window for tenancies expiring on or after 1 May 2025, with the rollover consequences if you miss the cutoff
  • Proof-of-service records — what to capture, how to capture it, and how to store it so the evidence holds at the Tribunal
  • Retaliatory notice defence — how Section 54 works, the 28-working-day challenge window, and how to document an independent, non-retaliatory reason before serving notice
  • Tribunal application walkthrough — the possession order process under s 64, the filing fee, and the evidence assembly sequence
  • Bond refund and abandoned property — the Bond Hub process, the 12-working-day response window, pet bond rules from December 2025, and the abandoned goods disposal framework
  • Legislative timeline — every change from December 2024 through April 2026, with the effective dates and transitional rules, so you know which rules apply to your tenancy

You also get five printable standalone worksheets — a notice selection decision tree, a service date calculation worksheet, a proof-of-service log, a Tribunal evidence checklist, and a notice period timeline planner — plus a one-page checklist covering every step, form, fee and deadline.

Who This Is For

You are a private landlord in New Zealand who manages your own property. You need to end a tenancy — selling, moving back in, a fixed term expiring, or a tenancy that is not working — and you want to get the notice right the first time. You do not have a property manager or a legal team. You need a reliable system that tells you which notice to serve, how to calculate the dates, how to prove you served it, and what to do if the tenant stays.

Why Not the Free Government Forms?

Tenancy Services provides notice templates. They are accurate and free. But a blank notice template does not:

  • Calculate your deemed-receipt date for the delivery method you used
  • Tell you that the 42-day owner-occupation notice is unavailable for trust-owned properties
  • Warn you about the fixed-term non-continuation window or the rollover consequence
  • Create a proof-of-service record that holds at the Tribunal
  • Walk you through a possession order application if the tenant stays

The forms tell you what to fill in. This guide tells you how to get the dates right, which notice is legally available for your situation, and what to do when the process does not go smoothly.
