Accidental Landlord in Manchester: Do You Need a Licence?
You did not set out to be a landlord. Maybe you inherited a property and decided to let it rather than sell. Maybe you moved in with a partner and kept your old house as a rental. Maybe you bought a flat as an investment without fully researching what Manchester requires. Whatever brought you here, the licensing rules apply the same way regardless of how you ended up letting the property.
The Licensing Requirement Does Not Care About Intent
Manchester City Council's selective licensing designations target all privately rented properties within designated areas. There is no exemption for accidental landlords, first-time landlords, or landlords who did not know the scheme existed. If the property is inside a designated street schedule and you are letting it to a tenant, you need a selective licence.
The same applies to mandatory HMO licensing. If the property is occupied by five or more people from two or more households sharing facilities, it needs a mandatory HMO licence — citywide, regardless of whether the property sits in a selective licensing area.
Inherited Properties
Inheriting a rented property does not inherit the previous owner's licence. Under the Housing Act 2004, a landlord licence cannot be transferred to another person. When the original licence holder dies or the property changes hands, the licence terminates. The new owner must apply for a fresh licence in their own name.
If the inherited property is already tenanted, you are legally operating an unlicensed property from the date the original licence ceased to be valid. Submit a complete application immediately — a "duly made" application provides a statutory defence against prosecution while the council processes it.
Former Homes Kept as Rentals
The resident landlord exemption only applies when you live in the property as your main residence with no more than two lodgers. Moving out and letting the whole property to tenants removes that exemption. If the property is in a selective licensing area, you now need a licence.
Many landlords who relocated from Longsight, Moss Side, or Harpurhey and kept the property as a rental are caught by this. The selective licensing designation may have come into effect after you moved out, meaning the property was fine when you started letting it but is now licensable.

Buy-to-Let Investors
Deliberate buy-to-let investors in Manchester face the same regime. No exemption exists for properties held through limited companies — the company can be named as the licence holder, with a director or managing agent as the local contact. The application process and fees are identical to those for individual landlords.
If you are purchasing a property in a designated area, factor the licensing fee (£798 to £964 for selective, plus ongoing safety certificate costs) into your investment calculations. Licensing is a legal requirement, not an optional extra.
What to Do First
- Check the address — email
[email protected]for written confirmation of whether the property is in a designated area - Count occupants and households — five or more people from two or more households triggers mandatory HMO licensing instead
- Gather documents — gas safety certificate, EICR, EPC, floor plans, tenancy agreement, proof of title
- Submit a complete application through the council's online portal — incomplete submissions are not "duly made" and do not provide the statutory defence
- Pay the Part A fee — the licence is not applied for until the fee is paid
Do not wait for a council letter. Manchester City Council conducts proactive enforcement and data matching. By the time you receive a warning, the offence is already on record.
