Enfield Licensing Conditions and Property Inspections: What to Expect

A property licence in Enfield is not a one-off submission — it carries ongoing conditions that the licence holder must maintain for the full licence term. Breaching a licence condition is treated as seriously as operating without a licence, carrying civil penalties of up to £40,000 per offence.

Mandatory Conditions on Every Licence

Every selective and HMO licence in Enfield includes conditions under Schedule 4 of the Housing Act 2004 plus Enfield's own local management standards:

Gas and electrical safety. Submit a current Gas Safety Certificate to the council annually. Maintain a satisfactory EICR, renewed every five years.

Smoke and carbon monoxide alarms. Working smoke alarms on every storey of the property — mains-powered or sealed 10-year battery units. Carbon monoxide detectors in every room with a fixed combustion appliance (gas boiler, open fire, wood burner). Check and test these at the start of every tenancy.

Tenant referencing. Before granting a new tenancy, request and verify written references from prospective tenants. This is a licensing condition specifically aimed at preventing anti-social behaviour in licensed areas.

Anti-social behaviour management. Keep a written record of any ASB complaints at the property. Investigate complaints, issue formal warnings to tenants where appropriate, and cooperate with the council's enforcement team. The licence holder is expected to take reasonable steps — not ignore problems.

Waste management. Provide adequate domestic and recycling bins. Store bins inside the property boundary between collection days. Inform tenants in writing of the council's waste collection schedule.

Occupancy limits. Do not allow more people to live in the property than the licence permits. For HMOs, this is tied directly to the room sizes and amenity ratios submitted at application.

What Council Inspections Look Like

Enfield's Private Sector Housing Team has statutory entry powers under Section 239 of the Housing Act 2004 to inspect licensed and licensable properties. Inspections can happen:

  • Before the licence is granted — the council may inspect during processing
  • During the licence term — routine compliance checks
  • In response to a complaint — from a tenant, neighbour, or other agency

Officers inspect the property against the 29 statutory hazards under the Housing Health and Safety Rating System (HHSRS), covering everything from excess cold and damp to fire safety and structural risks. They also check compliance with the specific licence conditions — alarm placement, waste storage, room size restrictions, and document availability.

If Category 1 hazards (the most serious) are found during an inspection, the council is under a statutory duty to take enforcement action — improvement notices, prohibition orders, or emergency remedial action — regardless of the property's licensing status.

Licence Variations

Material changes to the property or management arrangements require a licence variation under Section 69 (HMO) or Section 92 (Selective) of the Housing Act 2004. Examples include:

  • Changing the managing agent
  • Updating the licence holder's contact details
  • Altering room layouts or capacity

Apply for variations through the same online portal. Minor administrative changes generally have no fee, but changes that expand occupancy capacity may require a re-inspection and additional processing costs.

Licence Duration and Renewal

Selective and HMO licences in Enfield are issued for up to five years. The council can issue shorter licences — typically one year — if there are compliance concerns or if the property needed improvement works as a condition of grant.

When the expiry date approaches, you need to submit a fresh application — licences do not auto-renew. Submit roughly two months before expiry to avoid a gap in coverage. There is no grace period; operating on an expired licence is the same offence as operating without one.
