Enfield Selective Licensing: What Private Landlords Need to Know in 2026

Enfield Council's selective licensing scheme came into force on 1 September 2026 and runs through 31 August 2031. If you let a single-household property — one family, a couple, or a solo tenant — in any of 17 designated wards, you need a selective licence. Letting without one is a criminal offence carrying a civil penalty of up to £40,000 per offence.

This is separate from HMO licensing. Even if your property has nothing to do with house shares, the location alone can trigger the requirement.

What Enfield Selective Licensing Actually Covers

Selective licensing applies to non-HMO residential properties: houses, flats, and maisonettes let to a single household or to one or two unrelated people who do not share facilities in the way that would make the property an HMO. It operates under Part 3 of the Housing Act 2004.

Enfield's previous selective scheme covered 14 wards from September 2021 to August 2026. The replacement scheme expanded coverage to 17 wards split across two legal designations:

  • Designation 1 (13 wards): Bowes, Brimsdown, Bullsmoor, Carterhatch, Edmonton Green, Enfield Lock, Haselbury, Jubilee, Lower Edmonton, Ponders End, Southbury, Upper Edmonton, and Whitewebbs.
  • Designation 2 (4 wards): New Southgate, Palmers Green, Southgate, and Town.

Four wards — Cockfosters, Grange Park, Winchmore Hill, and Bush Hill Park — remain outside the selective licensing area. Properties in those wards still need an HMO licence if they house three or more sharers, but single-household lets are exempt from licensing entirely.

How Selective Licensing Sits Alongside HMO Licensing

Enfield runs three licensing regimes simultaneously, each triggered by a different occupancy arrangement:

  • Selective licensing (17 wards): single-household lets and properties with one or two unrelated occupants.
  • Additional HMO licensing (borough-wide, September 2025 – August 2030): properties occupied by three or four people from two or more households who share facilities.
  • Mandatory HMO licensing (borough-wide, national standard): properties occupied by five or more people from two or more households.

HMO licensing overrides selective licensing. If a property in one of the 17 selective wards houses three sharers, it needs an additional HMO licence — not a selective licence.

Fees and the Two-Part Payment Structure

The selective licence fee is £750, split into two payments:

  • Part 1 (£450): paid when the application is made and non-refundable.
  • Part 2 (£300): paid when the council issues your draft licence (Notice of Intention).

Discounts are available at the Part 2 stage: £100 off for an EPC rated C or above, and £50 off for NRLA, LLAS, UKALA, British Landlords Association (BLA), ARLA Propertymark, or Safeagent accreditation. A landlord who qualifies for both pays £600 total instead of £750.

Multi-dwelling blocks under single ownership get a different break — the Part 1 fee drops to £350 for every flat after the first.

What Happens if You Let Without a Licence

The council can issue a civil penalty of up to £40,000. Tenants can apply for a rent repayment order through the First-tier Tribunal, recovering up to 24 months of rent. And while your property is unlicensed, you cannot serve a valid Section 8 notice to recover possession.

Enforcement is data-driven. Enfield matches council tax records, land registry entries, and housing benefit data to identify unlicensed lets.

Licences from the Previous Scheme

If you hold a licence issued under the 2021–2026 scheme, it remains valid until the expiry date printed on the certificate. The start of the 2026 scheme does not void existing licences early. But when your current licence expires, you will need to apply under the new scheme — and you should submit the renewal roughly two months before expiry to avoid a gap.

There is no statutory grace period. The moment a licence expires, operating without a submitted application is an offence.

Next Steps

Verify whether your property falls in a designated ward using the council's address checker. Postcode searches alone can give misleading results along ward boundaries — always confirm by exact address.
