Manchester Licence Variation: How to Change the Manager or Property Details

When You Need a Licence Variation

A Manchester landlord licence — whether selective or mandatory HMO — is tied to specific people and specific property circumstances. Some changes require a formal variation; a different licence holder needs a new licence application.

The most common triggers:

  • Change of managing agent — you switch from self-managing to using an agent, or change from one agent to another, provided the agent is not the licence holder. If the agent is the licence holder, the existing licence must be revoked and a new application made.
  • Alteration to room layouts — you change the number or layout of bedrooms; changes affecting the permitted occupancy also require a variation.
  • Reduction or increase in permitted occupancy — circumstances change the number of occupiers the licence covers

What a Variation Cannot Do

A licence variation adjusts the details of an existing licence. It cannot transfer a licence to a new owner. Under Sections 68(6) and 91(6) of the Housing Act 2004, a landlord licence cannot be transferred to another person or entity under any circumstances.

If you sell the property, the council will revoke the existing licence. The buyer must submit a new application in their own name, go through the fit and proper assessment, pay the applicable fee, and wait for the council to process it. There is no shortcut.

How to Apply for a Variation

Apply through Manchester City Council's licence-variation process for your licence type. If you are unsure which route applies, contact the Private Sector Housing team at [email protected]. The council will assess:

  • For a new managing agent — the incoming agent must pass the fit and proper person test. The council checks for criminal convictions, housing law contraventions, and previous enforcement history, just as they would for a new licence application.
  • For a room layout change — you may need to submit updated floor plans showing the new configuration, with room dimensions in square metres, fire door positions, and smoke detector locations.

No fee is payable for a variation request under Manchester City Council's licensing policy.

Timing Matters

Do not wait until the council discovers the change during an inspection. If your managing agent changes and you do not notify the council, the licence conditions are technically being breached — the named manager no longer has authority over the property. That is an enforceable breach, even if the property itself is perfectly maintained.

Similarly, if you have altered room layouts or changed the occupancy arrangement, the licence conditions no longer match the actual property. Operating outside the terms of your licence is treated the same as a licence condition breach under Section 72(3) or Section 95(2), carrying civil penalties of up to £40,000.

The Landlord Licensing in Manchester guide includes the full variation process alongside the main application workflow, so you know exactly when and how to notify the council of changes.
