Peterborough Overseas Landlord: UK Residency and Managing Agent Requirements

The UK Residency Requirement

Peterborough City Council requires that every property licence holder is a UK resident. This applies to all three licensing schemes — selective, additional HMO, and mandatory HMO. If you own a rental property in Peterborough but live overseas, you cannot hold the licence in your own name.

This is not optional and there are no exceptions. The council needs a licence holder who can be contacted, served with legal notices, and held accountable under English law. An overseas address does not provide the legal certainty the council requires.

Appointing a UK-Resident Licence Holder

If you are an overseas property owner, you must formally appoint a UK-resident individual or company to serve as the named licence holder. In most cases, this is a UK-based managing agent or a UK-resident family member or business partner who has day-to-day control of the property.

The appointed licence holder must be the "most appropriate person" to manage the property. Under the Housing Act 2004, this means someone who has the authority to:

  • Collect rent from tenants
  • Execute or terminate tenancies
  • Access all areas of the property for inspections and maintenance
  • Directly authorise maintenance and repair expenditure

A UK friend who has no involvement in the property's management would not satisfy this test. The council expects the licence holder to have genuine, demonstrable management control.

Legal Liability Falls on the Licence Holder

This is the critical point that overseas landlords must understand. The named UK licence holder assumes full legal liability for compliance with every licence condition and every statutory notice served by the council. If the property fails an inspection, if licence conditions are breached, or if a civil penalty is issued, it is the licence holder — not the overseas property owner — who is legally responsible.

This means your managing agent is taking on significant personal or corporate risk. Most professional agents will charge accordingly, and the arrangement should be documented in a formal management agreement that clearly sets out the responsibilities, indemnities, and the flow of information between the overseas owner and the UK licence holder.

The Fit and Proper Person Test

The appointed UK licence holder must pass the Fit and Proper Person declaration, just like any other applicant. This means disclosing any unspent convictions relating to housing offences, fraud, violence, drug trafficking, unlawful discrimination, or offences under Schedule 3 of the Sexual Offences Act 2003.

If your managing agent or representative fails this test, the licence application will be refused. You would need to find a different UK-resident person to act as licence holder.

The Application Process for Overseas Owners

The application still goes through the Home Safe portal. The UK-resident licence holder completes the Yoti biometric identity verification using their own identity documents (UK driving licence or passport). They submit their own proof of address.

For the property ownership documentation, you will need to provide proof that the overseas owner holds the freehold or leasehold — typically a Land Registry Title Register extract. The application should also include details of the mortgage lender (if applicable) and the formal management agreement between the overseas owner and the UK licence holder.

What Happens If You Do Not Appoint a UK Licence Holder

If you own a property in Peterborough that requires a licence and you do not appoint a UK-resident licence holder, the property is operating unlicensed. The penalties are the same as for any other unlicensed property — civil penalties of up to £40,000, potential prosecution with an unlimited fine, and the risk of tenants or the council applying for a Rent Repayment Order covering up to 24 months of rent.

The council does not make allowances for the difficulty of managing a property from abroad. The licensing obligation exists, and the UK residency requirement is clearly stated in the scheme documentation.

Changing Your Managing Agent

If your UK managing agent changes — either because you switch agents or because the individual leaves the company — the existing licence does not transfer. You must apply for a licence variation through the Home Safe portal, naming the new licence holder. The new person must also pass the Fit and Proper Person test.

During the changeover period, there should be no gap in licence holder coverage. Arrange the variation before terminating the existing agent's appointment if possible.

Our Peterborough Landlord Licensing Guide covers the full application workflow including the overseas landlord route — from appointing a UK licence holder to completing the Home Safe portal and handling licence variations when management arrangements change.

Frequently Asked Questions

Can an overseas company hold a Peterborough property licence?

The licence holder must be a UK resident. If an overseas company owns the property, a UK-resident individual (such as a managing agent or company director based in the UK) must be appointed as the named licence holder.

Does the overseas owner need to complete Yoti verification?

No. The UK-resident licence holder completes the Yoti identity verification using their own documents. The overseas owner provides proof of property ownership separately.

What if my managing agent is based in London, not Peterborough?

That is fine. The licence holder must be a UK resident — they do not need to live in Peterborough specifically. However, they must be able to fulfil the management duties effectively, including attending inspections and responding to council notices.
