PRS Database Penalties: What Happens If You Don't Register

The Penalty Tiers

The Renters' Rights Act 2025 creates a tiered enforcement system. The consequences escalate based on the severity of the breach and whether it's a first offence or a pattern.

The registration duty rolls out region by region from 15 December 2026. Enforcement for a missed registration deadline follows the deadline for the property's region.

Current GOV.UK guidance says unoccupied properties do not yet need registration; the requirement to register them before marketing will come under future legislation.

Initial Breaches: Up to £7,000

Under Section 91, marketing a property, granting a new tenancy, or failing to update information within 28 days without an active entry carries a civil penalty of up to £7,000 per breach. Each property and each breach counts separately — an unregistered landlord with three properties faces potential penalties on all three.

Serious or Repeat Offences: Up to £40,000

Section 92 covers landlords who knowingly or recklessly submit information that is false or misleading in a material respect, or who continue non-compliance beyond the specified 28-day period after a relevant penalty. At this level, councils can impose a civil penalty of up to £40,000 or initiate criminal prosecution through the Magistrates' Court.

Rent Repayment Orders: Up to 24 Months' Rent

Section 98 of the Act expands the Rent Repayment Order (RRO) regime. Tenants or local housing authorities can apply to the First-tier Tribunal for an order requiring the landlord to repay up to 24 months' rent — doubled from the previous 12-month maximum.

RROs can be triggered by knowingly or recklessly providing materially false or misleading information, or by continuing a relevant breach beyond 28 days after a penalty has been imposed and the final notice has not been withdrawn.

The Possession Bar

The most consequential penalty isn't financial. Under Section 90, a court cannot grant a possession order under most Section 8 grounds while a landlord's entries are inactive. This effectively locks you out of recovering your own property until you register and reactivate. Only anti-social behaviour grounds (7A and 14) are exempt.

How Enforcement Works

Local housing authorities run the enforcement process under Schedule 5 of the Act:

  1. Notice of Intent — the council issues this within six months of gathering evidence of non-registration
  2. 28-day representation period — you can submit written evidence or proof of compliance
  3. Final Notice — sets the penalty amount and payment instructions
  4. Appeal route — you have 28 days to appeal to the First-tier Tribunal (Property Chamber), and the penalty is suspended pending the tribunal's decision

Local housing authorities enforce the database requirements under Schedule 5 of the Act. The Act does not guarantee that a landlord who registers late will avoid enforcement.

How to Avoid Penalties

There's no complexity here. Register before your regional deadline, keep your entries active, and update within 28 days of any qualifying change. The enforcement framework is severe, but it only catches landlords who either ignore the requirement or let their registrations lapse through missed renewals.

Practical steps:

  • Set renewal reminders 30 days before your annual activation date
  • Log Gas Safety and EICR renewal dates so you can update the portal within 28 days of each new certificate
  • If you use an agent, verify their uploads are on time — penalties fall on the landlord regardless
  • If you registered late but before any enforcement action, complete registration immediately and keep a record of the steps you took — late registration does not guarantee that enforcement action will be avoided

The PRS Database Registration Guide covers the full enforcement framework and includes a compliance timeline tracker to keep you ahead of every deadline.
