Sunderland HMO Temporary Licence: When the Council Issues a Short-Term Licence

Most mandatory HMO licences in Sunderland run for five years. But some landlords receive a licence for just 12 months. This shortened term can be tied to a planning problem, specifically missing C4 planning permission in an Article 4 ward.

Why the Council Issues Short Licences

Sunderland's housing licensing team and planning department operate independently. The licensing team can grant an HMO licence based on the property meeting the mandatory threshold and passing the fit-and-proper person test, even if the property doesn't have the planning permission it needs for HMO use.

When the licensing team identifies that a property in an Article 4 ward lacks C4 planning permission, they may still grant the licence — but for a reduced term, typically 12 months. This gives the landlord a window to apply for planning permission and regularise the property's status. If planning permission is obtained within that period, the landlord can apply for a full 5-year licence at the next renewal.

The five Article 4 wards in Sunderland are Barnes, Hendon, Millfield, St Michael's and St Peter's. Within these wards, converting a Class C3 dwelling to a Class C4 small HMO (3–6 occupants) requires express planning permission — the national permitted development rights have been withdrawn. Properties elsewhere in Sunderland retain those permitted development rights for C3-to-C4 conversions.

The Planning Enforcement Risk

Operating an HMO without the required planning permission is a planning breach, regardless of whether you hold a valid HMO licence. The council's planning enforcement team can:

  • Issue a planning enforcement notice requiring the use to cease
  • Prosecute for non-compliance with an enforcement notice
  • Refuse future planning applications where there's been a deliberate breach

Having an HMO licence doesn't provide a defence against planning enforcement. The two regimes are legally separate — a licence authorises the occupation arrangement under housing legislation, while planning permission authorises the land use under planning legislation.

What to Do If You Get a Short Licence

If you receive a 12-month licence, the practical steps are:

  1. Apply for C4 planning permission immediately — don't wait until the licence is about to expire. Planning applications take time and there's no guarantee of approval.
  2. Check the 10% density rule — Sunderland's Core Strategy Policy H6 uses a 10% HMO-concentration threshold within a 100-metre radius. Proposals that would exceed it are likely to be refused.
  3. Gather evidence of established use — if the property has been used as an HMO for more than 10 years without enforcement action, you may be able to apply for a Certificate of Lawful Use instead of planning permission. This is a legal route, not a loophole, but it requires solid evidence.
  4. Prepare for the licence renewal fee — when the short licence expires, you'll need to apply for a renewal (£865 in 2026/27) or, if the licence lapsed, a new application (£1,037). Short licences cycle through renewal costs faster than 5-year terms.

Properties Outside the Article 4 Wards

If your property is in a Sunderland ward outside the Article 4 designation, C3-to-C4 conversions benefit from Class L permitted development rights and don't need planning permission. For these properties, the licensing team will typically issue the standard 5-year licence term. Large HMOs (seven or more occupants, sui generis) require full planning permission everywhere.

The Sunderland Landlord Licensing guide maps the Article 4 wards, explains the planning permission routes and includes a decision framework for determining whether your property needs planning consent alongside its HMO licence.
