Wales Written Statement 14-Day Deadline and Compensation
The 14-Day Clock Starts on the Occupation Date
Under Section 31 of the Renting Homes (Wales) Act 2016, every private landlord must deliver a complete written statement of the occupation contract within 14 days starting with the occupation date. The occupation date is the date the contract-holder is entitled to begin living in the dwelling as their home.
So if the occupation date is 1 November, Day 1 is 1 November and the 14-day period ends at midnight on 14 November. There is no fee for providing the initial written statement — the landlord cannot charge for it. If the contract-holder requests an additional copy later, a reasonable administrative fee is permitted, but the landlord must supply it within 14 days of the request or fee payment.
What the Written Statement Must Contain
The written statement is not a summary or a covering letter. It is the binding legal document setting out the terms of the occupation contract. It must include:
- Key Matters — names of the parties, property address, occupation date, rent amount, payment frequency, and contract type (periodic or fixed-term standard).
- Fundamental Terms — statutory provisions from the 2016 Act covering essential rights, including the unalterable anti-discrimination terms under Sections 54A and 54B (in force since 1 June 2026).
- Supplementary Terms — day-to-day operational provisions from the Renting Homes (Supplementary Provisions) (Wales) Regulations 2022.
- Additional Terms — any bespoke clauses agreed between landlord and contract-holder.
The Welsh Government publishes model written statements for periodic and fixed-term standard contracts. Landlords must use the updated versions published on 29 May 2026 that incorporate the anti-discrimination provisions.
What Happens If You Miss the Deadline
Section 87 of the Act creates a mandatory compensation entitlement when a landlord fails to provide the written statement on time. The contract-holder is entitled to statutory compensation equal to one day's rent for each day the statement remains unprovided, calculated from the occupation date, up to a maximum of two months' rent. Statutory interest accrues on top.
This is not a discretionary penalty — it is automatic. The contract-holder can apply to the county court for the compensation, and the landlord cannot avoid it by arguing the contract was honoured in practice. The written statement is a standalone statutory duty.
Beyond the financial hit, a late or missing written statement restricts the landlord's ability to serve a no-fault possession notice under Section 173. If the statement remains unprovided, the landlord cannot serve one. If delivered late, the landlord is barred from serving one for six months from the delivery date.

How to Prove Delivery
Proof of delivery is the landlord's responsibility. The three lawful delivery methods under Sections 236 and 237 are:
- Personal delivery — handing the hard copy directly to the contract-holder at the dwelling.
- Postal service — first-class post or prepaid recorded delivery to the dwelling address.
- Electronic service — only if the contract-holder has indicated willingness to receive the document electronically, the text is received in legible form, and it can be used for subsequent reference. An email address on file alone does not establish willingness.
For every method, keep a written record: a signed delivery receipt, a recorded-delivery tracking number, or a copy of the electronic document and evidence of the contract-holder's willingness to receive it electronically. Each joint contract-holder must receive an individual copy of the written statement, and each delivery must be evidenced separately.
The Compliance Sequence in Practice
The 14-day deadline sits inside a broader compliance sequence that starts before the contract-holder moves in:
- Confirm Rent Smart Wales registration and licensing.
- Obtain all mandatory safety certificates (EPC, Gas Safety, EICR) and install interlinked smoke and carbon monoxide alarms.
- Select the correct model written statement (periodic or fixed-term standard).
- Complete all required terms and key matters.
- Deliver the written statement and Form RHW2 (Notice of Landlord's Address) within 14 days.
- Protect any security deposit in an authorised scheme within 30 days and issue the Prescribed Information.
Missing any step in this sequence has knock-on effects — but the written statement deadline carries the most immediate financial penalty.
