Waltham Forest Fit and Proper Person Test for Landlords

What the Test Covers

Every property licence application in Waltham Forest — selective, additional HMO, and mandatory HMO — requires the proposed licence holder and any named property manager to pass a fit and proper person assessment. The council won't grant a licence to someone it considers unsuitable to manage a rented property.

The test focuses on four areas:

Unspent criminal convictions: Specifically convictions involving fraud, violence, drugs, or sexual offences. Spent convictions under the Rehabilitation of Offenders Act 1974 don't need to be declared, but evidence of the conduct underlying a spent conviction may still be considered in the fit-and-proper assessment. The threshold for "spent" depends on the sentence length and offence type.

Housing law breaches: Any prior findings of non-compliance with the Housing Act 2004, previous licence revocations, or enforcement action by any local authority — not just Waltham Forest. If another borough has revoked your licence or imposed a civil penalty, that history follows you.

Discrimination findings: Any finding of unlawful discrimination by a court or tribunal in connection with property management or letting activities.

Previous licence revocations: If you've ever had a property licence revoked anywhere in England, the council will want to know why and whether the circumstances that led to revocation have been addressed.

Who Gets Assessed

The assessment applies to:

  • The proposed licence holder — typically the landlord receiving rental income
  • The proposed property manager — if different from the licence holder (e.g., a managing agent)
  • For corporate licence holders, the company and a nominated responsible officer

The licence holder must be the "most appropriate person" to hold the licence. For most small landlords, this is the individual property owner. If a limited company owns the property, the company itself is named as licence holder alongside its Company Registration Number, registered address, and a nominated officer.

Overseas Landlords

If you live outside the UK, you must appoint a UK-based managing agent or representative with a valid UK address for service of legal notices. Both you and the UK-based representative undergo the fit and proper person assessment.

What Happens If You Fail

The council can refuse to grant a licence if the proposed licence holder or manager fails the assessment. This doesn't mean the property can't be licensed — it means a different person needs to be proposed as licence holder, or a different managing agent needs to be appointed.

In practice, a refusal based on fit and proper grounds is relatively rare for small private landlords with clean records. The council is more concerned with identifying landlords who have serious criminal histories or a pattern of housing law non-compliance.

Preparing Your Declaration

Gather the information before you log into the portal. You'll need to confirm or deny each disclosure category and provide details where applicable. Having the details ready avoids delays in your application — an incomplete fit and proper declaration is a common reason applications aren't accepted as "duly made."

The Waltham Forest Landlord Licensing Guide walks through the full fit and proper person declaration process, including what to disclose and how prior enforcement history from other boroughs is handled.
