Waltham Forest Property Licence Conditions: What You Must Comply With
Conditions Attached to Every Licence
Getting your licence granted is only half the job. Every property licence in Waltham Forest — selective, additional HMO, and mandatory HMO — comes with conditions that last for the full licence term. Breaching licence conditions is a separate offence under the Housing Act 2004, carrying civil penalties of up to £40,000 and criminal prosecution with uncapped fines.
Safety Certificate Conditions
Gas safety: Maintain a current Gas Safety Certificate (CP12) and arrange annual checks by a Gas Safe registered engineer. Submit the certificate to the council on demand.
Electrical safety: Keep a valid Electrical Installation Condition Report (EICR) with a satisfactory rating, renewed within five years. The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 make this a legal requirement independent of licensing, but the licence condition means the council tracks your compliance.
EPC compliance: Maintain at least a Band E Energy Performance Certificate. Properties that fell below Band E after April 2018 must have been improved or hold a valid exemption on the PRS Exemptions Register.
Smoke alarms: Working smoke alarms on every storey used as living accommodation. The licence condition requires you to test them and keep records.
Carbon monoxide alarms: Required in every room containing a gas or solid-fuel appliance. Again, test and record.
HMO-Specific Conditions
Additional and mandatory HMO licences carry extra conditions:
Fire safety equipment: Additional HMO licences need mains-powered alarm systems and emergency lighting with certificates. Mandatory HMO licences need Grade A LD2 alarm systems — a higher standard that requires professional installation and testing.
Room size compliance: HMO bedrooms must meet statutory minimums (6.51 m² single, 10.22 m² double, 4.64 m² for a child under 10). No room under 4.64 m² can be used as sleeping accommodation. The licence specifies the maximum number of occupants per room.
Management Regulations compliance: HMO managers must follow the Management of Houses in Multiple Occupation (England) Regulations 2006 — maintaining fire escapes, common parts, structural fixtures, water and gas supply, and waste disposal facilities.

Tenant Management Conditions
Tenant references: Selective and HMO licence holders must request and evaluate references for incoming tenants. The council frames this as a measure to deter anti-social behaviour. You don't need a formal referencing service — documented reference checks are sufficient.
Waste management: Provide adequate storage bins and clear disposal instructions to tenants. In practice, this means ensuring the property has enough bin capacity for the number of occupants and that tenants know the collection schedule.
Tenancy agreements: Provide written tenancy agreements to all occupants. Keep copies available for inspection.
Inspections
Council officers conduct inspections under Section 239 of the Housing Act 2004. They must give at least 24 hours' written notice to occupiers and owners before entry. Inspections can be proactive (routine compliance checks) or reactive (responding to complaints).
Reduced Licence Terms
Most licences run for the full five-year scheme period. But the council can issue a reduced one-year term if you have previous non-compliance history, unresolved planning permission issues, or persistent gaps in documentation. A one-year licence means annual reapplication and higher cumulative fees.
Tracking Compliance Over Five Years
The practical challenge is maintaining compliance across the full term. Annual gas checks, five-year EICR renewals, alarm testing records, and tenant referencing all need documented evidence you can produce on demand.
The Waltham Forest Landlord Licensing Guide includes a five-year compliance tracker covering every condition, with reminder dates for certificate renewals and inspection preparation.
