Waltham Forest HMO Room Size Requirements and Amenity Standards

Statutory Minimum Room Sizes

The Licensing of Houses in Multiple Occupation (Mandatory Conditions of Licences) (England) Regulations 2018 set minimum sleeping room sizes that apply to every HMO licence in Waltham Forest — additional and mandatory alike. These are not guidelines. The council attaches them as licence conditions; permitted sleeping use depends on the room area and the age and number of occupants. A room below 4.64 m² cannot be used for sleeping accommodation.

Room use Minimum floor area
One person aged 10 or over 6.51 m²
Two persons aged 10 or over 10.22 m²
One child under 10 4.64 m²
Any room below 4.64 m² Cannot be used as sleeping accommodation

Measure the floor area using the council's rule: any part of a room where the ceiling is below 1.5 metres is excluded. If a bedroom measures 6.2 m² after that deduction, it fails the single-occupancy threshold even though the room looks adequate on the estate agent's floor plan.

Floor Plans for the Application

Your licence application must include a floor plan showing the dimensions of every room in square metres. For selective licences, a layout plan showing room use is sufficient. For additional and mandatory HMO licences, the council expects a detailed plan with measured dimensions marked on each room.

You do not need an architect. A clear hand-drawn plan with accurate measurements taken with a laser measure is acceptable, provided it is legible and shows room use (bedroom, kitchen, bathroom, communal area) alongside the measurements.

Kitchen and Bathroom Amenity Standards

HMO licence conditions in Waltham Forest follow the broader London amenity standards. While the exact ratios depend on the number of occupants and the property layout, the general expectations are:

Kitchens. A shared kitchen needs adequate facilities for occupants to prepare, cook and store food. Check the council's current HMO guidance and licence conditions for the number and type of appliances required for your occupancy.

Bathrooms. Provide adequate facilities for personal hygiene. The required number and arrangement of bathrooms and toilets depend on the property's occupancy and licence conditions, so confirm the current requirement with the council rather than relying on a general ratio.

Communal areas. Common parts — hallways, staircases, landings — must be kept clear, adequately lit and maintained by the licence holder or managing agent under the Management of Houses in Multiple Occupation (England) Regulations 2006.

What Happens if a Room Is Too Small

If one of your bedrooms falls below the minimum, you have two options:

  1. Reduce the stated occupancy. Remove that room from the sleeping allocation on your licence application. The maximum occupancy on your licence will drop accordingly, but the application can proceed.
  2. Check proposed alterations. If the room is close to the threshold, ask the council how it will assess any proposed change before relying on it to meet the standard.

Do not submit an application claiming a room meets the minimum when it does not. The council can inspect and will measure. Knowingly or recklessly supplying materially false or misleading information to a local housing authority is a separate offence under Section 238 of the Housing Act 2004.

Our Waltham Forest landlord licensing guide includes a room measurement worksheet and the full evidence matrix for each licence type — so you can check every room before starting the online application.
