Brent HMO Room Size Requirements and Amenity Standards

Statutory Bedroom Minimums

The Licensing and Management of Houses in Multiple Occupation (Mandatory Conditions of Licences) (England) Regulations 2018 set statutory minimum sleeping-room sizes for mandatory HMO licences in England. Brent Council applies these thresholds through its HMO licence conditions:

Occupancy Minimum net floor area
1 person aged 10 or over 6.51 m²
2 persons aged 10 or over 10.22 m²
1 child under 10 4.64 m²

Any room with a floor area below 4.64 m² cannot be used as sleeping accommodation at all. The licence itself will state the maximum number of occupants permitted in each room.

How Floor Area Is Measured

Measurements use net floor area — the usable space at standing height. Any section of floor where the ceiling height is below 1.5 metres is excluded from the calculation. In attic conversions and rooms with sloped ceilings, this can substantially reduce the usable area. A bedroom that measures 8 m² on a standard floor plan might only count as 6 m² once the low-ceiling zones are stripped out.

Floor plans submitted with HMO licence applications must show these net areas in square metres, room by room, with ceiling heights marked.

Amenity Standards

Brent Council expects HMO properties to meet management standards under the Management of Houses in Multiple Occupation (England) Regulations 2006. Its application and inspection process considers kitchen, bathroom and toilet facilities in relation to the occupancy. Check the applicable licence conditions for the required provision for your property's layout.

Fire Safety

HMO licence conditions include fire safety requirements under the Regulatory Reform (Fire Safety) Order 2005 and the Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022:

  • A written Fire Risk Assessment, reviewed regularly
  • Working smoke alarms on every storey
  • Carbon monoxide alarms in rooms with gas or solid fuel appliances
  • A clear fire escape route shown on the floor plan
  • Any additional precautions identified in the Fire Risk Assessment and the applicable licence conditions

The Fire Risk Assessment and applicable licence conditions determine what additional fire precautions a property needs. The HMO floor plan should show its fire escape route.

What Happens If a Room Is Too Small

If a bedroom falls below the minimum size for its stated occupancy, the licence holder must reduce occupancy in that room. Brent Council can issue a licence with a reduced occupancy cap, and exceeding the stated maximum is a breach of licence conditions — carrying fines of up to £5,000 per breach or a civil penalty of up to £40,000.

Advertising a room as a double when it measures under 10.22 m² puts the landlord at immediate risk.

Getting Room Measurements Right

If you are unsure about your floor plan measurements, hire a surveyor or use a laser distance measurer. The council checks submitted measurements against its own inspection readings, and a discrepancy can delay or derail an application.
