Coventry HMO Licence Conditions: What Every Landlord Must Follow
Your Coventry HMO licence comes with a set of binding conditions, and serious or repeat breaches can attract a civil penalty of up to £40,000 per offence — the same maximum as operating without a licence — since 1 May 2026. Most landlords read the fee schedule carefully, pay the Stage 1 and Stage 2 fees, and then file the licence document without studying the conditions attached to it. That is where enforcement risk lives.
What Conditions Are Attached to a Coventry HMO Licence?
Every Coventry HMO licence — whether mandatory, additional, or Section 257 — carries two layers of conditions. The first layer is the statutory national conditions set out in Schedule 4 of the Housing Act 2004, which apply to every licensed HMO in England. The second layer is Coventry City Council's own local standard conditions, published as Schedules 1 and 2A.
The national conditions require the licence holder to produce a valid annual gas safety certificate to the council on request, keep electrical appliances and furniture supplied by the landlord in a safe condition, install and maintain working smoke alarms, and supply each occupier with a written statement of the terms on which they occupy the property.
The local conditions are more detailed and cover occupancy limits, bedroom floor areas, kitchen and bathroom amenity ratios, fire detection systems, waste management, and property maintenance.
Occupancy Limits and Room Size Enforcement
Your licence specifies a maximum number of occupiers for the entire property and a maximum per bedroom. The national minimum for sleeping is 4.64 square metres, but Coventry's local standard sets a 10-square-metre minimum where no separate communal living space is provided. A single bedroom for one person aged 10 or over needs at least 6.51 square metres when separate communal living space exists, rising to 10 square metres without it. Double bedrooms need 10.22 square metres with communal space or 15 square metres without. The floor area calculation excludes any part of the room where the ceiling height drops below 1.5 metres.
Exceeding the stated occupancy limit — even by one person — is a licence condition breach. It does not matter that the room might physically fit another bed.
Waste Management Conditions
Coventry's Schedule 2A conditions include specific waste management duties that catch landlords off guard. You must supply standard 240-litre external wheelie bins: green-lid for non-recyclable waste, blue-lid for dry recyclables, and brown-lid for garden waste where applicable. Inside the property, you must continuously provide and maintain two separate 50-litre kitchen bins — one labelled "non-recyclable waste" and one labelled "recycling." If the property has a brown garden bin, an internal food waste caddy must also be present.
You are also required to issue written waste disposal instructions to tenants that prohibit placing bins on the footpath more than 24 hours before or after collection day.

Fire Safety and Management Duties
The licence holder must keep fire escape routes clear, maintain the fire detection system in working order, test emergency lighting at the required intervals, and display landlord contact details prominently inside the building. These obligations sit alongside the Management of Houses in Multiple Occupation (England) Regulations 2006 for Section 254 HMOs and the Management of Houses in Multiple Occupation (Additional Provisions) (England) Regulations 2007 for Section 257 HMOs, which impose duties to maintain common areas, structural elements, and services.

What Happens if You Breach a Condition?
Coventry City Council can issue a civil penalty of up to £7,000 for a first or minor breach and up to £40,000 for serious or repeat offences. Alternatively, the council can prosecute in the Magistrates' Court, where conviction carries an unlimited fine and a criminal record. A pattern of breaches can lead to licence revocation and, under the worst circumstances, a management order that takes the property out of your hands entirely.

Getting the Conditions Right From Day One
The conditions are not aspirational standards — they are legal obligations from the date the licence is granted. The cheapest way to manage them is to read every schedule before the first tenant moves in, build the waste management and fire safety requirements into your setup costs, and measure every bedroom before advertising the property.
Our Coventry landlord licensing guide walks through every condition in plain language, with a dated compliance checklist you can work through room by room.
